SSN for a K-2 and EAD?

hi, my fiance (k-1) as well as my daughter (k-2) entered the u.s not too recently. i filed a SSN for both of them only my fiance was able to obtain one, my daughter was not. the person at the Social security administration office told us that my daughter will need employment authorization to work. First thing that entered my brain was, my daughter is 3 years old there are child labor laws that wont allow her to work.

with alot of frustration and finally accepting that an EAD I-765 needs to be filed with the USCIS, my question is am i able to file the EAD I-765 and after that file for AOS I-485? or do i need a green card for my daughter before she can obtain a EAD I-765 from USCIS?

A K-2 is not entitled to a SSN like a K-1 is.

You can file the EAD for the daughter, I know it sounds silly because she is a kid, but that will allow the SSN to give her a SSN. The EAD is free when filed with a pending I-485. It will be approved before the Greencard, most likely. You cannot file it before AOS.

Or, you can skip the EAD and just wait for the Greencard to be approved. She can get a SSN with her GC.
