AOS and an old citation

Hi all,

I arrived in the US on Sunday on my K-1 visa, now very happily living with my fiancee in Brooklyn. We are going to apply for AOS in late April after we are married.

I am currently completing the I-485 and unfortunately have to declare (as per question 1. b) in Part 3 of that form) that in January 2007 while in the US as a student in Georgia I was given a citation for underage possession of alcohol. I was 20 at the time, and obviously an idiot!

I called the clerk's office in the town where this happened in rural Georgia to ask if they could send me some form of documentation showing that I paid the citation ($250), that I wasn't charged and that no further action was taken. The woman I spoke to was very pleasant, told me she would send the requested documents in the mail today and said she didn't think it would have any bearing on my AOS or Green Card as it was a misdemeanor that was settled at the time.

I think it should be fine, but nonetheless does anyone have any experience with this? Should I include a letter/note from myself explaining the situation stating that I realise it was stupid and is the only time I have been in trouble with the law in any way? I am just worried about getting an RFE and slowing the process.

Yes, you will have to declare it and get the paperwork. It will be fine, but you will have to send in documentation. Don't ask random people about immigration in the US because few have any dealing with it. Good luck and congrats on the upcoming wedding.
