Married in DR but wife has been petitioned by sister-Advise!

Hey guys,

A friend of mine recently married in Dominican Republic. The thing is that his wife has a pending application with USCIS (not clear if she received NOA@) the thing is that there hasnt been any movement in the case for 3yrs now. My friend wanted to cancel that petition and petition for her as a spouse.

The kick is that she was married before, they tried to petition her and it was denied. Not sure why, he said it was because of a mistake in the application.

What should I advise him?

I did tell him to check the stats of the opened case and to ask a lawyer if her previous petition will affect her coming to the USA. Any other advise i could be missing?

There's red flags all over this one. married before and denied a CR-1 before. open petition by a sister. And now another marriage and another CR-1? There will definitely be extra scrutiny during her interview. Has he seen the actual denial letter or was this just what was told to him?

The petitioning part on his side will be pretty straight forward, but when she gets to the interview, she'll need very solid proof this is a real marriage and not just an attempt to get to the USA.

He doesnt have the letter nor any documentation of her case. Sucks for him but ill let him know. Thanks so much.
