Hi! My AOS is still pending at CSC, a headhunter got me a job,which is waiting for me, but this headhunter told me to go to a local INS office & ask for a letter stating that all my AOS papers are already in the process, & that letter will help me to start working even my AOS is still in the process. We don't want to believe him for what we know is that I am not yet legally able to work while my AOS is still pending. Am i right? Does anyone knows anything about getting a letter from INS that will give you the authorization to work while your AOS is still in the process?

10/19/2006 - Notice DAte

11/01/2006 - RFE notice

11/02/2006 - Sent back RFE requested

You need a valid EAD to work - a letter will not suffice. However, it sounds like the headhunter thinks that if you prove your papers are in progress, the company will take the risk of hiring you in the meantime.

You definitely cannot work with just a letter from USCIS. You need either an EAD card or the GC in order to be able to work.

You are not work authorized while your AOS application is "pending".

You could show your employer the NOA you received after sending in your AOS application as proof that you are awaiting approval. Then, if your employer wants to offer you a position, that is fine, but you cannot actually start working until your AOS has been approved.

It is very unlikely that USCIS would supply you with a letter to confirm that your application is in progress.... they will tell you that you will get a NOA in the mail with the receipt number to show it has been recieved.... if you tell them you want the letter for employment reasons they will tell you that you will need a EAD to work... a letter confirming you have applied for AOS does not give you employment authorization...
