Possibility of ex-spouse creating problems at the Embassy

Hello, all,

I'm in the middle of a court process to get full custody of my children so I can take them with me to the US - at this point we have shared custody and I have main guardianship (they live with me), and my ex-husband moved to another country last year (yet he refuses to sign the authorization). I'm getting a scan of the Readiness Form I received in Packet 3, a scan of the envelope from the Embassy, and a screenshot of my CEAC status, as proof of my pending visa process. At this point I'm only sending this to my lawyer, so it may be that my ex won't even get to see the scans, but my fear is that if he does, in possession of my case number, he might try to contact the Embassy and create problems for me.

Has anyone had any experience with this? Do you know if this happens often or not?

I was the petitioner for my fiancée from Thailand and her 2 children. The embassy will require you to get a "LETTER OF CONSENT" from your ex, stating that he approves the children can emigrate to another country. At my wife's embassy interview they also asked her to go back to her Ex and get a photo copy of his photo ID to add to the authentication of this LETTER OF CONSENT. This is an official document executed and witnessed and notarized by city officials that will also be requested by customs as you enter the new country. If you do not get this letter there is a good chance that customs and immigration will deny entrance to the USA of your children and they will be forced to return to your native country.

I was the petitioner for my fiancée and her 2 children coming to the USA. You will be required to have for the embassy interview as well at the border crossing a document from your EX call "LETTER OF CONSENT" and a copy of his photo ID. This is a legal document that must be prepared, witnessed, and notarized by a government official. If you don't have this your children will not get the visa and will be denied border crossing by customs and immigration and will be returned to their country of origin. We complied with this and had no trouble.
