I filed an affidavit of support during the fiancé visa process and now I have to file another one for the adjustment of status? I am on disability and made enough for the fiancé visa but this one requires more income than I have. Not sure what to do.

The I-485 requires a legally binding affidavit support to be submitted, which is the I-864 This is why many consulates require the 125% with the I-134, because they know you need to adjust status and supply an I-864 after you marry.

If you do not meet the 125% requirement, you can make up the difference with assets, or use a joint sponsor.

You have to file this so that your now spouse can stay in the US it is legally binding as the other one isn't as stated before are increase your income/assets or use a joint sponsor or your spouse leaves the US

This will not be over quickly. You will not enjoy this.

Hello, I too am working on the affidavit of support for AOS, how do I do the joint sponsor paperwork? Do my joint sponsor and I fill out the I-864? Also my joint sponsor is using his land and other truck as his other assets. My joint sponsor made 25,040.94 for the year 2013, and his land is worth 19,748 and his truck is other truck is worth 5,000. Can we use this as assets? And if so is this enough to meet the requirements? Our joint sponsor has two dependents, plus himself, and my husband who he is sponsoring. So its a total of 4 in all. Please help. Thanks so much.

Good luck to you and I hope you can find a joint sponsor. Its been hard for us too to supplement the income requirements even though I own my own land and am not on any assistance. Good luck and God bless you.

land would count as an asset in the asset section, must to provide a certified appraiser's document showing the appraised value.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

I get a housing allowance from a ministry I am involved in. Does anyone know if that could count as income?

Thanks

Can free housing be counted as income?

Yes, sponsors receiving housing and other benefits in place of salary may count those benefits as income. The sponsor may count both taxable and non-taxable income (such as housing allowance). The sponsor must prove the nature and amount of non-taxable income. Evidence of such income can be a W-2 Form (such as Box 13 for military allowances), Form 1099 or other evidence.

The equity in the land can be used if there is recent appraisal by a licensed appraiser. No appraiser, then no good for the I-864. It's an absolute requirement to get a licensed appraiser if you want to include the land. The appraisal will cost around $300-$500.

Truck can be used if it is not his only vehicle. If it is his only vehicle, then he cannot use it for the I-864. Blue book value is sufficient.

Best of luck.
