Do you know anything about it?

I was planning to petition my bf. he is from the Philippines. Unfortunately when i called USCIS today, since same sex marriage is illegal in the Philippines, i asked the agent if i can just petition my bf and then marry him here in the US, unfortunately she said no. She said we should get marry first before i petition him. Iam just sad because theres no same sex marriage allowed in ASIA as far as i know.. Anyone who can help?

I know i have a diferent case, and so please show respect. Thankyou guys!

By the way Iam just a greencard holder not a citizen.

You can marry your BF in Brazil. Same-sex marriage is legal there since 2013. The best thing is Filipinos do not need to get a visa to visit Brazil so you two can go there and presumably get married. I just don't know if Brazil only allows residents to marry or if they let visitors marry, so you might want to check on that.

Once you are married in Brazil, then you can sponsor your husband as the spouse of a permanent resident. Something you should consider is whether there will be an immigrant visa available for your spouse immediately (category F-2A) or whether it would be faster to wait until you naturalize before sponsoring him.

2016-Sep-15: NOA receipt date

2016-Sep-19: $590 check cashed by USCIS

2016-Sep-20: NOA/ 1-year extension letter received in mail

2018-Feb-26: ROC case transferred to local office

2018-Mar-06: ROC approved via USCIS website (WAC status check)
