Hello,

I just mailed my petition today for the I130 and AOS and feel like I missed some things please tell me if I could be denied. I sent the EAD petition with the AOS packet and I put 2 passport photos with it was the EAD supposed to get its own photos?

On the I864 I filled out and submitted my tax transcripts and my mom is joint sponsor and filled out the I864a I submitted her tax transcripts proof of retirement and birth certificate...I saw here that I am supposed to send a letter from my employer with it what happens if I didnt do that? Can it be denied?

What happens now will my husband get his EAD card withinn 90 days or not until our case is approved? Will we have one interview or one for each petition? Not sure what happens next any info would be greatly appreciated!!

If you submitted the EAD with your I-130/I-485 AOS packet, then you don't need additional photos.

As for the employer letter, I'm not sure, someone with more knowledge in that subject area should chime in. Is your joint sponsor's (mother's) income alone enough to meet the 125% poverty line threshold? Worst-case, you get an RFE an things are delayed a month or so. Just make sure if you get an RFE to check in here BEFORE you send anything back in, because if there is still a problem they'll probably deny your application outright and you'll have to start over from the beginning, and yes that includes sending a brand new $1070 fee.

Your husband should get his EAD before his green card. It shouldn't require a separate interview. It will, however, require a biometrics appointment (this same biometrics appointment will be used for his AP if you applied for it, and will also be used for his green card). After the biometrics appointment, ~1-2 months later he should get his EAD. If you are like us, we got our EAD in the mail a mere 10 days before our green card interview, so it ended up not mattering. That is a good problem to have!

A letter from your employer is not required, just suggested to avoid possible RFEs. Some people send in a letter from their employer, 6 month worth of pay-stubs, or both. If the USCIS feels like they need more evidence to support proof of income, they may RFE you for it, or they may not.

To give you hope, I didn't send any proof of my income aside from my previous tax returns, and I didn't get an RFE nor any questions and we got our green card in the mail yesterday! I even was missing one tax return because I didn't file that year (I included a letter explaining why). In hindsight I should have sent in a letter from my employer. But I tell you this to give you hope!
