Monday I just sent a I-130 petition for my brother-in-law. Now I need help desperately. Tonight he called and informed my husband that his ex wants to move to Spain and wants him to take custody of their daughter. Is there a way that we can attach a visa for the the little girl to the visa for my brother-in-law? If so, how would we go about doing it and what do we need?

You can not petition brother in laws.

Could you explain exactly what you have done?

If your husband is now a USC and has petitioned his brother then nothing needs to be done.

Yes, my husband is a citizen now and we want to bring his brother. My question is what we need to do to bring our niece with him or do we have to wait until he has his green card. We sent the I-130 already for my brother-in-law and we listed that he had a daughter. What kind of documentation would we need to bring her too?

Obviously he would have to have her birth certificate and I am assuming a letter or something from the mother stating that she authorizes him to take her. I am a little concerned because she is a citizen of a different country than he is.

She will be 15 before this becomes an issue, worry about it nearer the time.
