Hey there,

My wife and I are almost ready to send my AOS package off-- and as the title states, she only filed her taxes for 2013 and 2012. In 2011, she made under the required amount needed to file. The unfortunate thing is we don't have her W2 for that year or anything either, and don't want to guess. So here are my questions about the i-864!

For Part 6 question 13, can we still check-mark the box even though she only filed for the 2 most recent tax years?

For Part 6 question 13c, can I write "see attached" instead of a guessed number (since we don't have her W2 and don't have any proof of what she made-- just the understanding that it wasn't required in her case) and then write a small statement saying that she was not legally required to file according to IRS since she made under the amount needed?

And lastly,

We don't think we have enough time to request transcripts from the IRS. So we were going to send copies of our 1040EZ, W2, pay stubs, and employment letter for the tax year 2013-- will this be enough?

My wife makes over the poverty guidelines, if anyone needed to know that before they could give me a correct answer.

Same thing happened with my husband, he lived in Canada & made no income in 2011 so he didn't file for that year. We went on the IRS website and requested proof of not filing, printed it off, and attached a statement from him saying why he wasn't required to file. We just left that space blank for 2011. Not sure if we did it the right way, but that is what we did. Also we did NOT check the box off saying he filed for the past 3 years, since he didn't.

We don't think we have enough time to request transcripts from the IRS. So we were going to send copies of our 1040EZ, W2, pay stubs, and employment letter for the tax year 2013-- will this be enough?

Perfect! Thank you both!! I never realized the IRS transcripts/verification of non-filing was available for immediate printing on their website. Glad that's solved :)

If someone whose undergone the AoS process successfully can verify my other questions for both myself and future readers, that would be greatly appreciated! Trying my best to avoid an RFE :P

You can check the box and cross through three and write two above it, leave it as is and checked, or not check it. I am not sure it makes that much of a difference, as I have personally not seen anyone get an RFE simply for that box being checked or not.

Hand-write SEE ATTACHMENT for 13c and add a statement explaining that you were not required to legally file that year because you did not meet the income threshold.
