My EAD on F1 visa expired november 26,13 and I applied for change of status to H4 to the Vermont Service center


The processing time says 2.5 months, but its over 4 months, it is still under review.


My husbands H1 is extended till 2015, and he has his I797.

I received my I797C - notice of action confirming receipt of petition.


We recently received Canadian PR, and got to land in Canada before June 18th. They cant extend the expiry date under normal circumstances.


1. Without a H4 visa, can I go to Canada and return on the automatic revalidation process?


2. Can you directly go for H4 stamping before you get your H4 approval? Like, just exiting the country, and applying for a brand new H4 visa with marriage certificate and husbands H1 papers?


3. This question is assuming I get my H4 visa approval in the next few weeks - can I drive to Canada, and return on the automatic revalidation process without having to do stamping?


Another option is - my Husband could go and activate the PR, and I ask for PR expiry date extension citing the visa and pregnancy(due june10)

Update 7 april 2014 : The USCIS website updated the site and the petition has been approved. It is in the post decision phase directly.

So hopefully I should receive the 797 within few days to a week.

So, can I just go and return with the automatic revalidation program.? Or do I need to go for stamping?
