I have my wife here now after a long year wait with the USCIS on a I-129F, she is with me now and married. Just yesterday after a lot of stress finally got the AOS package sent out to them, Cause 90 days after arrival and wedding and still another $1070.00 dollars sent to them is a big headache within that short time.

I was reading about lifting conditions?????

another affradavit of support and evidence???? #######...fo these people at this stage still dont get the fact that were happily married and we abide by all rules and enough is enough?

Yep, it is good to know all the fees in advance so you can prepare.

You don't need another affidavit of support for ROC though.

You'll be done with the paperwork in five years when she's eligible for citizenship... it's a relief to have it over with in the end! But don't stress too much... you're together, you're happy, you're married, and all the rest is just formalities. (hugs)

LOL, i remember my spouse asked me one night "we are not going to spend another $1070 to get the 10 years gc, right?"

after we got married we decided to relax for few months from working on the AOS, we decided to have fun, going places, and not think about papers. After 4 relaxing months we started the AOS papers, i'm glad we didn't get stress after wedding, lol.

I'm surprised that someone is just learning about AOS and removal of conditions after having gone through the fiance visa process. It would seem to me that one needs to look at the entire process before starting the initial paperwork. You weren't tricked in any way. That's the way the process has worked for a long time.

Sorry about getting ready to sound so ignorant/stupid. Are ya'll saying we don't need to complete the AOS paperwork and now that we are married don't have to do anything more?

Quite the opposite! Those who entered on a K-1 must complete and submit the AOS package. (You can simultaneously file for EAD & AP at no extra cost.) In 2 years, you must file for Removal Of Conditions on the 2-year green card. Approval of ROC gets you a 10-year green card. You can apply for citizenship a year thereafter.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Would thing for what the USCIS charges for these forms, could walk into field office with the required evidence. They would ask us questions and properly fill out the forms for us. But the way it is, with one omission, can reject our applications, keep the fees, do not pass go, do not collect 200 dollars, and go directly to jail.

Threat of a $250,000.00 fine and up to a five years prison sentence doesn't help, its the same penalty for copying a DVD! And if a US citizen is a victim of fraud, no help whatsoever from the USCIS, just read sections on this board where US citizens were stuck with that I-864 for the next ten years.

Should be accustomed to this, been collecting sales tax for years for the state with no compensation whatsoever and huge threats with fines if I am even a penny short. Very accustomed to threats by our government with so-called freedom. Can wonder how legal my oath was to die for this country when my only other choice was to go to jail if I didn't show up when I was drafted.

With deadlines, no choice but to skip our honeymoon and fill out forms, I-693 for two people was the toughest for us, trying to find a USCIS approved doctor that wouldn't rob us blind, health insurance doesn't cover stuff like this, at least mine didn't. Only to wait 13 months, get grilled to death about fraud, only to find out, only conditional green cards were offered.

ROC was our worse possible stage, even the one year extension expired, had to make a 450 mile trip of I-551 stamps in foreign passport books. But after US citizenship for both my girls, it was finally over.

I'd honestly have rather had my husband here while we were waiting for everything to go through with the USCIS. But we really didn't have a choice, and had to go through the IR1 way. :) But when I moved to the Netherlands, I waited (and fought) with Dutch immigration for over 2 years to get my residency permit. It wasn't nearly as bad as being separated from my husband and going through this for the past year (+). At least we were still physically together to deal with the insanity.

No joke, if I had to do it again, I'd go IR/CR all the way.

Given the circumstances at the time, I wouldn't have done it any different than we did with the K-1. If I had more vacation time at the time, I would have done the CR-1. But it would have taken two more weeks worth of vacation to get to the other side of the world and meet all the requirements. Waiting to accrue that vacation time, would have put a good nine more months of delay on our timeline, plus the extra time a CR-1 takes. In the end, what matters is you're together regardless of which process you chose.

It would have been more stressful if you knew that once your spouse's I-94 expired (90 days after entry) that they were subject to be detained and ultimately deported by CBP until they received their NOA-1 for the I-485.

It appears most K-1 entrants are under the belief everything is fine once they get married. Generally it is, but on rare occasions you hear about it all going south fast wen the AOS isn't applied for. One of immigration bills, that will never see the light of day, actually had a provision to require K-1's adjust within 6 months. It didn't specify what would happen if they didn't, presumably it would require an I-130 and I-485 at that point.

OP yes, you have to AOS. Your spouse is in limbo until you do. They cannot leave the USA, they cannot work, they likely cannot drive or even get state ID. Many cannot be put onto insurance because they're not LPR either. So do the AOS, do the ROC, and then think about citizenship when you have the 10 year card. You can wait any time in that period to get citizenship. In fact if you do wait, after 5 years as an LPR your spouse will qualify on their own vs having to send MORE relationship evidence in.
