Ok, so at this point I don't care if its a 10 yr or conditional card. The question I need to know is do you get any notice after you file to renew the card or are you playing the waiting game til the new card arrives??

I have Naturalized and never had to renew my greencard. The question was more for informational purposes as someone I know was going to hire someone but discovered they had an expired greencard and wasn't going to hire them unless they showed her a renewed card.

I was wondering if you get a notice that a cards on the way much like the "welcome to America" letter we get just before our greencard arrives that this person could use in place while they wait for their new card to arrive.

That someone hiring can't demand to see any specific document. The job applicant can provide just SSN card and DL and be fine with e-verify.

If they knew there was an expired green card and the person was in country illegally, they can decide to not hire that person regardless of valid SSN or DL. However they cannot ask to see that particular document either unless they're immigration officials.

If this is a 10 year GC and the person is an IR-5 category then the fact that the GC is expired is irrelevant as their LPR status is still valid. Now if this is a 2 year conditional GC then the LPR status expires with the GC and that is why the person must file for ROC. This is the same as if I showed my expired passport. It is expired and not valid for ID, but the fact I have one does show I am a USC. If the SSC has been changed to one with out the wording "VALID FOR WORK WITH DHS AUTHORIZATION ONLY" then that also proves this person is a LPR and is legal to work.

They can always not hire a person, but I would be careful not to state the reason is that they think the person is in the US illegally when they may be. Better to use some other excuse to not hire this person.

Hi, if that person has a valid driver's license and a SSC it should be enough. DMV won't issue a DL unless the applicant can prove their legal status and they will make it valid until the proof of legal residence document expires. When I applied for my DL while having a 2-year conditional green card the DL was set to expire the same date as that GC. When I filed for ROC and got the letter that extended my GC for a year while I waited for the process to be complete, DMV only gave me a 1-year DL. On the other hand, like it was posted before, SS will state if that person can only work if allowed by the DHS.

So those two documents, if still valid, should be more than enough. Of course, that person can always provide a I-551 stamp after filing for renewal as evidence of residence.
