I have applied for my wife for CR1 category. When I applied I used her father's name since she had the old passport. Now being that said, she obtained a new passport under my middle name. I am worried that this may cause a problem when she go for interview. As of right now, we are at DS-260 stage, can anyone please advise what to do with this situation. She currently has two passport. one is canceled and one is current. The current one has my name and the canceled one has her father's name. Please advise.

What do you mean by middle name? It should be her LAST (Surname) that changed, not her middle name?

Either way apply for visa (DS-260) using current VALID passport name. No matter how you apply, Visa will come in passport name and green card will come in visa name.

the cancelled one passport has no bearing anymore on her application (she does not need to show it unless it is asked for for verification). it's the current passport that she will submit for her visa stamping. so she should be ok. although your description is a little confusing when you said that her new passport has your middle name? you meant your last name, right? if it's your last name then you did the right thing.

Why don't you know what to write?

Write the reason(s) why her last name changed just as you explained in your posts. Although you will have to explain & write clearly since more than one respondents here say your writing is confusing.

Write simple, short sentences when you send the letter of explanation to NVC. Good luck!

Part of the problem communicating in this thread is the use of the term last name. The OP is not explaining well, but using the terms family name or surname instead of last name, will facilitate clear communication. In some countries (like China where 1/3 of all humans live) the "first" name is the Surname/family name.

To the OP. Simply file all remaining papers for your wife using the name(s) as shown in her current passport.

After getting married to me

Mary James Patel.

now you see what I m talking about. Henry is her father name.. and James for example is mine. Patel is our surname. Now does seems clear to you.

Not really because it's not in my culture to change someone's given middle name. But apparently in your is it. Whatever is her LEGAL name as per her passport is what you should use.

Visa in passport name.

Green card in visa name.

so i can just send nvc the new passport copy(my name as her middle name) for supporting documents. I just called nvc the aos still in process but i already filled out ds260. Any idea how long it will for her to get an interview take if everything goes smoothly at nvc.

check the interview thread in the progress report forum. You may get an idea there.

Some embassies take a long time (Egypt has been waiting 5 months+) and others are fairly quick, the month after.

What name did you use on the DS260? I suggest you stop referring to your name and her fathers name. It sounds to me like what you're talking about is her old middle name and her new middle name. Why she changed her name has nothing to do with your question.
