hard to say....while a spouse of an LPR might not be able to do an AOS immediately, others have suddenly decided they needed to study basket weaving once they collected their luggage, and attempt an AOS to student visa....lots of possibilities...totally up to the CPB official of the moment.

Is it even possible to AOS to a student visa? - wouldnt be able to anyways, as college tuition is hugely expensive over there, dont wan't to go to college over there anyways, and I'm guessing it would be illegal.

I have the same problem, right now I'm already here in the US and just got married back on April and got my NOA1 few weeks ago. My I-94 is expiring on July and I need to go back to my home country but planning to go back around November to spend holidays with my husband. What do you think are my chances of passing POE without any problem?

I have visited my husband (LPR) several times and never had an issue.

Some tips:

- Say ALWAYS the true to the immigration officer. Don't lie about your trip purpose, you're there to visit your spouse.

- Don't be nervous and be nice.

- And of course, bring enough proof with you, showing you'll come back to your country after the visit. (Example: letter from work, business, properties, your i-130 approved, NVC documents showing you're waiting for interview at the US embassy, etc).

I have visited my husband (LPR) several times and never had an issue.

Did you tell them right away that you're there to visit husband or you're there for vacation and say you're visiting your husband after all the Q&A?

Did you tell them right away that you're there to visit husband or you're there for vacation and say you're visiting your husband after all the Q&A?

First time it was something like that:

Officer: What's the purpose of your visit?

Me: Holidays and visiting family

Officer: Who are you going to stay with?

Me: My husband

Officer: Is he a citizen?

Me: No, he's a permanent resident

Officer: How long are you going to stay?

Me: Until XX/20XX... X days

Another time, the officer asked me why I wasn't living with my husband, I said to her that we were doing the i-130 process, and she was actually very nice and everything went by without any issue.

Last time I said I was there for vacation and visiting my husband right away.. and then he asked again: Is he a citizen or LPR? I replied LPR, and that's it! :)

As long as you have enough proof that you are coming back and have a good history on your visits, you shouldn't have any problem to entry.

That's the thing for me, I stayed here for 6 months and will only be staying in my home country for 4 months and go back to spend holidays with my husband.. I just hope I will have the same experience as yours..

That's the thing for me, I stayed here for 6 months and will only be staying in my home country for 4 months and go back to spend holidays with my husband.. I just hope I will have the same experience as yours..

Oh I see! Just bring enough proof with you and don't be nervous, and if they ask, say you're following the right process to be with your husband eventually, but this time you're there just to visit, and you can visit with your B2 visa.
