I've read the threads at length with regard to visiting US Citizen spouse, and it seems very possible on the VWP, just show proof of ties, e.g NOA1, proof of employment/studies.

However is there more scrutiny placed on spouses wanting to visit their LPR spouse?

My wife, is going to send in her N-400 to be naturalised in July (residence requirement) - I am going to visit in June, so she will still be a LPR, will I have even more trouble convincing the CBP than someone who was visitng their US Citizen spouse?

Any experience, stories or advice anyone can share?

A spouse is considered a strong tie, if you have a spouse in the US (regardless if USC or LPR) that is a tie to the US, how will you combat this?

Like in the other threads, I'm confident my NOA1, and proof of an educational course starting, and just being flat out straight with the CBP officer, saying I don't want to jepordise my pending application in anyway.

I was just wondering if it is any different if the spouse is USC or LPR.

hello tim131 - here is my opinion:

it is easier to visit an LPR spouse than a USC spouse....especially if you can show ties and if your PD is not current.

Unlike being married to a USC, a LPR spouse cannot automatically adjust and they know you will need to go back to your home country to complete the interview etc...(or at least they should know that!).

You've put my mind at ease, our PD will not be current, and she wont have sent her N-400, so thats good.

Have you visited? what are your experiences? I should say I am visitng my wife? and just provide evidence?

Yeah, the VB has remained static right? hopefully it moves real soon!

As for my PD? Erm, tomorrow... maybe? My wife and I, being Mexican & Irish are fairly laid back about these things, and have the Manana syndrome, so hopefully she will be going to staples tonight to get the ACCO fasteners etc, and we can post it tomorrow!

May/June will be nice, not long at all, where are you based? where is based in the UK? - I used to live in London, and in Aberdeen, Scotland for a while :)

I'm LPR, my husband is Polish citizen, he visited me without any problems and the only question he was asked was "how long are you going to stay in the country?". That was after our I130 got approved. Ha has B1/B2 visa.

Also I recommend flying through Dublin in this case, so you know before entering the plane to US if they are going to let you in. But I also think they are much more strict there( was flying though Dublin twice. And it wasn't the nicest thing in the world..).

I am flying through Dublin, for the first time, so have no experience with the pre-clearance. They're more strict? how so may I ask? I will have the NOA1, confirmation I will be going to college in Sept and also have return flights.

Glad to hear about your husband though, it sounds promising! - Did he specifically say he was visiting his wife? and was he asked if you were a citizen etc, or was it literally a "I'm here on vaccation" - "ah grand on ya go" sort of affair?

Tim,

So the first time they forgot to send my immigration packet further so I waited for my Green Card few months, and spent so much time at calling them, USCIS and some other places.

Second time, well they had so many questions and I was warned that GC is not a tourist visa, and told that next time they will not let me in.. I was out of US just for 4 months..

Also I heard some stories about them being not so nice etc.

Although, my husband didn't have any problems while he was flying through Dublin, but that was before I filled I130..

For me flying through Dublin was the easiest because I lived in Dublin at that time.

Pre-clearance is simple. You are just going to terminal 2, then through regular check in and security. After that you keep fallowing american flags.. It will bring downstairs, then you will have two lines one for citizens and LPR other for everyone else and few windows with immigration officers. Then when they will call you to the window, they will check your papers, ask few question, show pic of your bag, take a picture of you and take fingerprints. And if all is good you good to go. You are on US territory :) you will go through one more security and then find your gate :)

Ah right seems a pain in the ####### there those times you went through! Yeah I live in Wicklow, so its definitely the handiest option for me. Hopefully it will be plain sailing - seems straight forward enough anyhow.

hard to say....while a spouse of an LPR might not be able to do an AOS immediately, others have suddenly decided they needed to study basket weaving once they collected their luggage, and attempt an AOS to student visa....lots of possibilities...totally up to the CPB official of the moment.
