A multimillionaire who pleaded guity to raping his three-year-old daughter has been spared jail after a judge in Delaware ruled he would "not fare well" in prison.
Robert H Richards IV, heir to the du Pont chemical business, was given eight years' probation and ordered to seek treatment after he admitted to raping his three-year-old daughter in 2009.
Judge Jan Jurden ruled that Richards, 46, should not be handed a custodial sentence as he would "not fare well in Level 5 [prison] setting".
Details about the sentence only emerged after the defendant's former wife, Tracy, filed a lawsuit against him seeking compensation and punitive damages over the abuse of their daughter and his son.
According to the lawsuit, Richards admitted to assaulting his son and daughter between 2005 and 2007. Richards was originally charged with two counts of second-degree child rape, which carry a 10-year minimum sentence.
Richards hired one of Delaware's top defence lawyers, Eugene Maure, who won a plea bargain.
Richards avoided a jail term after admitting one count of fourth-degree rape – a lesser charge which carries no mandatory minimum jail term.
Delaware public defender Brendan O'Neill, told the Detroit Press: "It's an extremely rare circumstance that prison serves the inmate well.
"Prison is to punish, to segregate the offender from society, and the notion that prison serves people well hasn't proven to be true in most circumstances."
O'Neil added the sentence "raised questions" about the treatment of wealthy people by the justice system.
Kendall Marlowe, executive director of the National Association for Counsel for Children, added: "Child protection laws are there to safeguard children, and adults who knowingly harm children should be punished.
"Our prisons should be more rehabilitative environments, but the prison system's inadequacies are not a justification for letting a child molester off the hook."
Defence lawyer Joseph Hurley said of a jail sentence: "Sure, they have protective custody, but that is solitary confinement for 23 hours a day. We're not a third-world society.
"Sex offenders are the lowest of the low in prison. He's a rich, white boy who is a wuss and a child perv. The prison can't protect them, and Jan Jurden knows that reality. She is right on."

Ah yes, money talks. Rich people should not be sentenced differently but that's how the system works. People of education and good financial standing will be treated more leniently. We aren't surprised are we?

This is sick that this sicko is given the benefit of no prison while his children are given the benefit of growing up with this dark cloud burdening them for the rest of their lives!

He should be under the prison!!! And if he doesn't fair well who cares? He can get a nice taste of what it feels like to be defenseless and no one to rescue you because the person with the power doesn't care.

Who ever said only black prow commit crime ? I agree this scum should be put under the jail along with the judge. I am sure if he were poor Not doing well in prison would not matter

Now Janelle, what did we talk about? You can't bring up race. They can, but we can't. No matter how many times they do it, no matter how many times they call our entire race into question, no matter how many times they turn 95% of the conversation into a whipping post for black people, we can't bring it up. It's for them and them alone to talk about black people, we don't get the privilege.

I've never seen someone post that only black people commit crimes.

I believe that Janelle is referring to the folks who say blacks commit the most crimes, the most murders, are just horrible people. We take a beating in here daily.

I believe that Janelle is referring to the folks who say blacks commit the most crimes, the most murders, are just horrible people. We take a beating in here daily.

The facts show that black people commit crimes at a much higher rate than other races. That's just a fact. Sorry if you and Janelle don't like facts.

I'd think black people would want to do something about that instead of blaming it all on racism. I suppose that's the easy way out though.

And I'm not arguing that. My problem is what does that have to do with the price of fish? This "fact" seems to come into threads that have nothing to do with black people. A crime committed by white people? Let's look at black crime stats. A shootout where the perp is a white teen? He's still not more dangerous than a black teen in a hoodie. Someone wants to talk about minimum wage pay? Let's look at how much black people make. An argument about solar panels(I still am shocked by this one)? Once again, the black community. What's even worse is most of the time Janelle and I aren't in the conversation, neither is any other black person, yet it still comes up. Or, is this the new rule? If a black person is involved, we have to shoulder the burden of explaining or taking responsibility of all black people.

Black people are doing something, I post stories about kids getting accepted into several Ivy league schools, only a few comments. There are quite a few out there making headway. There are also many who get the door slammed in their faces, but I don't like posting those anymore. Too many "get over it" comments here.

No one here has ever said that. In debates, when it has been asserted that the black culture begets crime no worse than others, we have pointed out that blacks, specifically young black males, commit crime at a vastly disproportionate rate to other races, respective of their percent of the population.

I asked that question also. You an d Janelle made this thread about race not any of us. My point in the OP, was about wealth and privilege, and how the judge let this rich guy off. The same way OJ got off because he was rich and famous, not because he was black

someone should check the judge's bank balance....I imagine it has increased dramatically, far beyond what his normal salary would produce. It's a shame that justice is for sale in this country.
