I would call. Use google voice (it's free) or magic jack. NVC already had my husband's email but not mine. But i gave them both again anyhow when I called.

1 - No

2 - no idea how to file an amended return - ask the IRS or in the Tax forum

3 - if the NVC recieves the AOS package before the 15th you don't have to include 2013 taxes. You can then send a new I-864 with tax transcript to your wife for her interview. If they don't recieve it by the 15th you'll be checklisted. If you wait on the amended you waste time but won't get a checklist.... Up to you.

4 - you have to file as MFS, MFJ, or HOH (if qualified.) So there is no reason NOT to file as MFS.

Sometimes people get emails with instructions and most times you don't.

NLR, they wont receive the AOS package before the 15. In order for me to do the amendment, are you saying that I will have to send it in and then wait for the transcript to become available? How long do you think that will take if I am filling out the 1040x as Married Filing Separately?

Cant I just send in the transcripts for the previous years, along with the return and amendment for 2013? Or does it have to be the transcript for 2013 also?

Did you already send all that? if you haven't, then take out all the beneficiary's original documents (that would be all part 9). You need this for the nvc stage... and also take out the original petitioner's birth certificate, only a simple photocopy is needed. Also, there is no need for taxes, employment letter or pay stubs.... The rest of the package is perfect!

If you already sent the package, then don't worry about it (you already sent it). However, USCIS might lose your originals, so start gathering them all over again....

I am no tax expert... But, you can (and have to ) file taxes if you have qualifying income you just can't claim yourself as you are already being claimed.

Per the IRS rules if you don't qualify to file taxes, then state that in the 864. Write a letter explaining why you don't have a tax return for the year. Of course, you'll need a sponsor for your spouse.

Your accountant would be the best person to explain your choices

First of all, a small and perhaps non-vital question on the AOS - our joint sponsor and her husband who file MFJ are doing an I-864 and I-864a respectively.

On the I-864 where it asks on page 1 -1.d. I am the only sponsor, vs 1.e. I am the first of two joint sponsors... would our joint sponsor choose 1.d? as her husband is only filling in the I-864a because it's recommended as the 'contract of household members' so to speak.

Or is her husband really considered a second joint sponsor?

Hi everyone, can some people give me some answers, my case was approved april 1st, my questions is, who gets notified when they recieve my case, since im using an attorney, and how many days does it usually take for them to receive it, it was approved at CSC, would appreciate peoples answers!!!

Probably at least a week or more for it to arrive from CSC, but you have to call NVC to find out for sure.

ps are you able to fill in your timeline so it can be useful to others on VJ? And also please correct that you have chosen DCF? - unless indeed your country allows DCF:)

April filer for spousal, going thru our attorney & he heard it was received in Chicago April 3. Hoping to get a file number from him soon. I'm praying this is a speedy as pain free process as it can be.

Do you mean your I-130 was approved? Have a peek in the forums for an April 2014 I-130 filers thread, or start one if it doesn't yet exist in this section.

Tax transcripts are available online instantly now, I recommend the joint sponsor goes back and selects the correct form for immigration purposes. The site will point him/her to which selection should be made for this usage.

Called NVC this morning, the nice lady told me that three weeks is a long time to not receive ENROLL acceptance from them. She suggested that I send the AOS and DS-260 supporting documents to them with a note in the body of the email that I had sent an email requesting to be added for Electronic processing 3 weeks ago and have not received a response yet therefore I would like to be ENROLLED and am attaching my AOS and DS260 supporting documents. But she did say, that we should have received an auto reply when Emailing the ENROLL, so if that is the case then it has only been two weeks. I will wait a few more days and call again, and if nothing, then I will do it the way she told me too. Anyone have any thoughts on this?

Our AOS package has been received, now in queue for reviewing. We did how the operator told us to. Didn't seem to have a problem. Only thing is that when reply to our AOS package email, they had to include the message of us being accepted in EP, so the emails are kinda messy...but that is the least problem for us to worry about!

Called again tonight in regards to the ENROLL. Apparently they are reviewing emails that were received before March 18th. I emailed ENROLL on March 19th so hopefully in the next day or two they will review it and send me an acceptance email

Sounds right! We received all our emails on the 5th. And now our AOS docs, which were sent on Mar 19, are pending for review.

They really need to put more people on reviewing/replying to Emails!!! Another Chinese beneficiary sent their ENROLL two days before we did, and received acceptance and a new case number A WEEK before me!

I am on hold at NVC right now... This was the worst ever case for me, 36 redials to get through. Never had that happen before even during normal busier hours!

Plus no music or background of multiple people telling us to be patient tonight.. only one guy coming on every minute or to say the agent are busy! It's so weird, I have become so used to the routine calling so many times over the last month.

Well I see that you sent your AOS out on the 19th, and they have already sent you email stating that they received AOS. The lady from NVC told me that they are only reviewing emails from before March 18th. But obviously that's not true seeings as they received yours sent on the 19th. Hopefully in the next day or so we hear from NVC.
