"Filing MFS will probably be the easiest for most people as it doesn't require any extra documents from the foreign spouse, nor does it require their signature.

On the tax return, where it asks for the spouse's SSN, you would put 'NRA' for Non-Resident Alien. Continue filling out the rest of the return as normal.

I haven't been able to find this out through reading the guides... some people talk about getting an email from NVC and it sounds like this is their first contact with them. So how did NVC get an email address from them? Are they using the email from the G1145 (or whatever that one was from I130) or from the USCIS notifications?

If so, they already have an email for hubby and I don't need to worry so much.

But if not, how did they get it?

So my question is: can I send an email to NVC only quoting my USCIS number, to add our email addresses? How should I format said email? Or do I need to keep calling and then send the email with my NVC case number to get the email ball rolling.

I know the phone seems to be much quicker, but I want the backup of email as soon as possible. Some of our documents took 3+ weeks to arrive by USPS/Canada Post, and that's way too long.

I would call. Use google voice (it's free) or magic jack. NVC already had my husband's email but not mine. But i gave them both again anyhow when I called.

1 - No

2 - no idea how to file an amended return - ask the IRS or in the Tax forum

3 - if the NVC recieves the AOS package before the 15th you don't have to include 2013 taxes. You can then send a new I-864 with tax transcript to your wife for her interview. If they don't recieve it by the 15th you'll be checklisted. If you wait on the amended you waste time but won't get a checklist.... Up to you.

4 - you have to file as MFS, MFJ, or HOH (if qualified.) So there is no reason NOT to file as MFS.

Just out of interest, I got the email with the invoice, however it says

"Before you begin, make sure you have a personal check from a U.S. bank account available. We will ask you to enter some information from the check later"

How come it asks for a cheque? Surely i pay with a visa no?

Also, did anyone get an email with an attachment with any instructions on what to send with the AOS and IV? Apparenlty i get this after the DS260?

I have a problem, I just filed my taxes a few days ago and my accountant receives and error saying that somebody already put me down that they support me which is my dad. Now my accountant says that I should tell my dad to take my name out of his tax papers. I was wondering, my dads income isnt enough so I filed for $19,800.. Can't I still send NVC my tax papers? they might accept it.. at this point my dad will not tell his accountant to take my name out of his tax papers. I filed as self employed because I don't work and secondly I just filed taxes for my husbands case

Called NVC this morning, the nice lady told me that three weeks is a long time to not receive ENROLL acceptance from them. She suggested that I send the AOS and DS-260 supporting documents to them with a note in the body of the email that I had sent an email requesting to be added for Electronic processing 3 weeks ago and have not received a response yet therefore I would like to be ENROLLED and am attaching my AOS and DS260 supporting documents. But she did say, that we should have received an auto reply when Emailing the ENROLL, so if that is the case then it has only been two weeks. I will wait a few more days and call again, and if nothing, then I will do it the way she told me too. Anyone have any thoughts on this?

the lawyers office pissed me off again today. The paralegal emailed AOS to me so I can sign it and send it back along with the divorce papers....When I looked it over before I signed..OMG there were so may mistakes and millions of blank spaces.... I had to re-do it, print it and fedex it over night for $24.00..... I am sooooo mad. I have done everything so far. Tomorrow I have to call and beg them to send out my packages. She told me we will have to meet to fill out the DS260.... I was like.... no, its cool. I'll do that one too. I'm so unsatisfied.... I could just scream

That would be fraud. If your tax return is rejected you can't submit as evidence as part of your AOS.

That would be fraud. If your tax return is rejected you can't submit as evidence as part of your AOS.

Hello everyone,

My case has been transferred to NVC on April 3rd, and at this time I'm waiting to contact them to ask about my case number & INN..also, I was wondering if I should wait to email them mine and my husband email address or should I just provide them our email addresses right now?

Also another confusion, hopefully Saylin will be able to help me, I didn't work last year at all but I went to school. I have 1098, & I tried to file the tax (even if I didn't have any earnings last year) by only with what I have that is 1098..but when I started the process of tax filing online ( which is what I every year do), the amount I was getting back was $0.. Am I still suppose to file the tax? Even if I'm not getting anything back or paying back anything? I don't want this to be an issue, later at the embassy because I know they are very strict about tax return documents..FYI my dad will be helping me with AOS documents and will be using his 3 years of tax return...please suggest what should I do? Still file tax even if the amount shows $0? Please help..the last day to file the tax is the 15th of April!
