Does it really take 30 business days for NVC to review the immigration visa application, DS261? They have reviewed and accepted all civil documents, fees, and DS260... I've seen other people on this forum that have got their case completes.

If my husband applies and receives a visiting visa and goes back for the immigration visa interview will this be a problem?

I'm utterly devastated now. I did not think it would take this freaking long... I don't even know if he'll be here for the birth of our first child. :'(

No, it generally doesn't take that long. As per other's signatures, I've seen 4 days to 2 weeks.

Beneficiary - Applying for CR1/IR1 (but also played the K3 card prior to understanding it may be phased out.)

2013: July 20: I-130 sent (Chicago lockbox)

July 24: I-130 NOA1

July 24: I-129F sent (Dallas Lockbox)

Aug 2: I-129F NOA1

Aug 12: Alien Registration Number was changed, I-129F.

2014: Jan 28/29/30: - 3 transfer notices for I-130 and I-129F.

Feb 3 - Hard copy arrived -Notice of transfer to Texas stating Jan 29th.

Feb 10 - NOA2

Feb 27 - email stating I-130 being sent to NVC from TSC.

March 6 -NVC received our case.

Also, did anyone get an email with an attachment with any instructions on what to send with the AOS and IV? Apparenlty i get this after the DS260?

The emails I received were actually just instructions to go pay, rather than itemized lists of what needs to be sent in the packages. I've never received a communication spelling out what documents were required; best I've seen is a link to the NVC site listing out the documents.

Go with the majority ;) Don't send your documentation for all the steps at once, it won't speed things up for you -- it'll just frustrate you later when you need to get new copies of everything for NVC. Read what's required for the I-130 packet and send just that for now.

Quick question while skyp'ing with hubby doing his and the joint sponsor's AOS forms:

-joint sponsor's transcript is called an 'account transcript', whereas my husband's is a tax return transcript. So her form doesn't list 'Total Income' as such, it has 'taxable income' and adjusted gross income (which I know we don't want to use as it wasn't a 1040 EZ).

Does she have to order the proper form again? Or will this account transcript suffice? If it's ok, do we use taxable income?

Tax transcripts are available online instantly now, I recommend the joint sponsor goes back and selects the correct form for immigration purposes. The site will point him/her to which selection should be made for this usage.

Does your husband not have an ESTA already? He'll probably be able to get one without issue if he doesn't, given they're a little more lenient for VWP countries than they would be on those needing a B2.

I have two questions about filling out Form I-864, Affadavit of Support. They might seem obvious, but we want to avoid getting a checklist.

  1. In Part 6 (page 5), question 13 says: "I have filed a Federal tax return for each of the three most recent tax years. I have attached the required photocopy or transcript of my Federal tax return for only the most recent year." -- and it gives you the option to either check the box next to the question or leave it blank. If my wife didn't file taxes one year, will it hurt us if we leave this blank (don't check the box)? She didn't file taxes because her income was $0 that year and she was living abroad with me. She used a tool on the IRS website that said she wasn't required to file.
  2. My wife and her mom co-own a house, and her mom is also filing the I-864 as a joint sponsor. In Part 7 where you have to list assets, should only one of them list the value of the house?

Hi everyone, can some people give me some answers, my case was approved april 1st, my questions is, who gets notified when they recieve my case, since im using an attorney, and how many days does it usually take for them to receive it, it was approved at CSC, would appreciate peoples answers!!!

No he doesn't have ESTA. He's not a UK citizen.. :( I've kept an eye on your timeline. I'm really praying for a case complete this week. Do you think the NVC is delaying the review of the DS 260 because we submitted all of our civil documents early? I mean they've accepted all civil documents and no real checklists were received..

This entire process has really done a number to my husband and I.. :(

Oohh I see, yeah, that makes it harder :( I can't see any reason why case complete wouldn't be this week for you based on the timelines around you, but there's nothing to do except keep waiting and calling. Maybe ask NVC next time you speak to them whether there's any chance of securing a May interview slot to get your husband home in time for the birth. I'm not sure what kind of special allowances London can or will make outside their normally scheduled interview assignment rounds.

April filer for spousal, going thru our attorney & he heard it was received in Chicago April 3. Hoping to get a file number from him soon. I'm praying this is a speedy as pain free process as it can be.

Two case numbers? You're interviewing in London right? You should have an LND number and that's it :wacko:

You're going to have to call, CEAC doesn't update with that information. NVC won't scan in your docs for a few days after receiving them though (so they won't have them on record yet), I'd try calling Thursday or Friday.

we got our DS261 submitted today, well our lawyer did, yay! I hope for no checklists! We are both a little concerned about this below from our lawyer (husband is an honest guy so wanted to let them now about these minor things, back when he was a rabble rouser hah, that are not on police reports)- anyone got any info on this stuff holding things up much? We are both worried yet hopeful that it won't cause a problem. Mr S is our top lawyer who our case manager had to consult, and Mr D is hubsters.

I apologize for my delayed response. I had to make sure Mr. S gave me the proper response to the question Mr. D and I were going back and forth with yesterday.
The question asked on the Visa Application was: Have you ever been arrested or convicted for any offense or crime, even though subject of a pardon, amnesty, or other similar action?
As per the information Mr. D provided, Mr. S instructed me to responded as such:
1990
ARRESTED: MINOR THEFT
PENALTY: 40 POUND FINE
1999
ARRESTED: BREACH OF PEACE
CASE DISMISSED
Even though your Police Certificate stated there is NO TRACE, Mr. S advised that you go to the court where both incidents took place and obtain whatever document they have referring to these cases. If the courts state that there is “No Record”, then to please obtain a certified letter from the court stating the same.
Mr. S does not see these matters to be of a concern, but it is important to have any document from the court to present to the Consulate should you be asked.
The visa application has been completed and submitted – now we wait for an interview notice. Hopefully the NVC will not ask for anything else. We have submitted all the required but sometimes they can come back and ask for additional documents that we are not aware of at this time. I will keep you informed.

Submitted all the documents 1.5 weeks ago, and the DS-260 about a week ago.

If they're reading the docs and issue a checklist, how soon do you get that email? Or is it advised to call each day to find out if we got a checklist?

Hi, I have same problem as you, NVC gave me incorrect case #, so I sent e-mail requesting to change it.

But I see that you proceed with filing AOS and paying fees, did you use wrong case number or what. I just don't know what to do, wait for new case number, the rep told me to wait, but knowing that they all have different answers I don't know what is better, but I definitely don't want to wait for 41 days. :no::o

I called NVC many times and they told me to send in the AOS and IV procedures before my case number changed. I have not sent in my IV package but have the cover sheet with the old case number. I was told it is fine to send it in and they can see in their records that my case number was changed. I changed my case number because my husband moved countries.

Although since yours was a complete wrong case number it might be different. They might just shut down the case number since it was wrong. I would suggest calling NVC and talking to at least 5 different people which I think Saylin mentioned before, just to be pretty sure of how you should proceed
