Re-asking

Can we just include the photocopy of our marriage cert and then say on the cover letter that I'll be bringing it with me to the interview because my husband already sent me the certified copy for our kid's CRBA

I'm not sure you can do that. If it were that easy everybody would be doing it. And nothing is easy in this process. If I were you I would call NVC and ask them first. Maybe call a few times and ask a few different people. See if the answer is the same. Because trust me, you don't want to get checklist!

Still I have doubt on AOS thing. My Wife (USC) is the petitioner here and she did not do any job in US also she doesn't have any tax returns, So my Father-in-Law is sponsor for me. So who will fill the I864 and is it required to fill any forms by my wife when submitting AOS. Please let me know what are required documents when submitting AOS?

FYI:Currently she is living with me in India.

One more question : Do we need to send original civil documents to NVC or US consulate in India?

Please advise me.

Paper file 2013 right away. You don't need ITIN#.

You can't file singe. For status use MFS.

Write NRA where SSN# goes on return (Non Resident Alien)

Include this 2013 Federal Tax Return return with your W-2s and all schedules

in your AOS package.

By the time you have interview transcripts should be available online

to print out and take to interview if needed.

thanks for your response Changnoi. we already sent our AOS packet and we even had a minor mistake with it but we don't have any problem with the financial part of the form and we sent the checklist march 20 so I guess they already accepted our AOS packet. anyways so if my husband is going to file MFS how long will it take for the transcript to be available?. see we're just waiting for our case complete this week or next week and hoping for last week of May interview or early June. will it be already available by that time??? and lastly will it end up having my husband owing a lot for his taxes compare to him filing single??? sorry for having a lot of questions and so thankful for your response. God bless :)

Question on filling DS260 NAME in native language.

I have never used native language to write my name even my birth certificate is written in English. Question is do we really need to write our name in native language. Can i just say N/A will i get a check list for doing that.

My birth certificate is in native language (i am submitting translation for that). When you start filling DS260, instructions says that use native alphabets when specifically asked. And here is this questions they specifically ask for this. So i have used my native font and filled this field.

I don't see any harm in doing so (also technology is available). Why to leave it blank.

I applied for an ITIN. Took less than a week to gather docs and send it to the husband in the US. We got our check 3 weeks later.

Easiest way would be to file separate tho you won't get as much $$$

I think because of your I-129f and I-130 approval.

What I saw is that if both cases got approved and touch NVC than they closed I-129f and at a same time they assign case # to I-130.

I saw this happened to other fillers too.

My cases have the same case number except the last digit ( obviously) The I-130 is 003 and the K-3 is 004 so they must have gotten them together. I don't mind doing the I-130 as long as it keeps moving fast... I am not in the mood to hang out at the NVC for 3 months.

11 months at USCIS was enough :clock:

I assume the reason both fees were issued at the same time is because I have an attorney and did not have to file the DS261?

I paid them on Saturday so hopefully when the bank opens I will see the funds coming out... it isn't processed like a POS/debit purchase ..correct? The funds would come out immediately, not put on hold .

really so you did file separate. did you try to call ssa to ask if you're eligible for ss#? my husband called IRS and advised him to have me call social security and personally ask if im eligible for one. anyways so if ever we wont have our transcript in time for interview if ever, do you think the consulate will not accept an extension letter and W2?by the way thank you for your response?? :) can I just ask too what are the documents that is needed for an ITIN?

Please advise me as soon as possible, so that i will prepare for paper work and if any docs required from my wife for submitting NVC, I will FedEx to USA to my father-in-law. :rolleyes:

Even if she's living outside the country and has no job in the US, she is still required to file an I-864. She's the petitioner, and she's sponsoring you to come to the US. You will definitely need a joint sponsor, so it's good you have your Father in law. He needs to fill out an I-864 as well. You can find what's required in the AOS package on the wiki page of the NVC, and on the NVC website. If she hasn't filed taxes either, she needs an explanation of why she hasn't and if she wasn't required to.

All documents must be original or certified copy that are sent to the NVC. (plus a photocopy). They will be forward to the embassy when they schedule your interview.

There is an option you can check that says technology not available. Or you can use Word and go under the symbols part and type your name. Then just copy it into the form. That's what I did for my hubby's name. It works. I just didn't want to leave it blank. If you check the other box for technology not available I doubt if you will get a checklist for that or they wouldn't give you that option. Hope this helps. :)
