(We attempted to deliver your item at 11:07 am on April 5, 2014 in PORTSMOUTH, NH 03801 and a notice was left because the business was closed. You may arrange redelivery by visiting usps.com/redeliver or calling 800-ask-usps, or may pick up the item at the Post Office indicated on the notice. I am thankful for your advice NLR. In either case I have no plan to decieve. In the beginning when we raised this question the lawyer said if you want to change the occupation of your wife you can file an amendment. He also added if you mention your wife as a house wife it is not wrong because she is a house wife as well. I don't know what is the worth of this statement legally, although it had been made by a lawyer :-) . DOS and IRS are working in different domains.as far as the filing of tax is concerned it is MFJ(a truth). My job mentioned in g-325 (another truth). The only discrepancy is my occupation in two different departments. I need to know should we file the amendment or it will be OK as it is as far as immigration is concerned.

I can't see it being an issue, BUT your embassy is not an easy one by any means. You may want to inquire in your regional forum or in the embassy discussion.

Seems it was a waste of valuable time and money for you to hire an attorney. Even at the USCIS stage you've done your own research and waited on your attorney to catch up. Can't you just fire him at this point? They don't understand the urgency and sensitivity with these type of cases.

He is for the waiver. If we didn't need that waiver, I'd be driving.

Hi everyone,

I am new member of visa journey. My I-130 has been approved in March. I need some help from other members of vj. My husband is USC by naturalization. He filed his tax for years 2010,2011,2012 & 2013 as MFJ. I have an ITIN as well. The actual issue is that in my ITIN and all tax papers the lawyer ,who filed the tax of my husband, showed me as house wife. In my home country I am working in a government organization. I showed my job in g-325 as well. Now the question is that will it affect my immigration case? Has any significance during the interview? What should we do now? Thanks in advance for the guidance.

Do you have USA income or is it foreign income in your home country.

If foreign income, then the question you need to ask is: weather you need to report that income on usa tax? Iam nor am expert but probably not.

The police clearance certificate is officially delaying our case now. We actually applied back in December and the first certificate came back with a spelling error in the address. We tried to go get it fixed. It's one letter that needs to be changed! They made us re-apply and go through the entire process again! We re-submitted the application in late February and we're still waiting. I'm tempted to send in the first certificate and explain the situation. Wonder if they would allow us to bring the new one to the interview.

The checkmark in question 13 of Affidait of Support I864 about filling last 3 years of taxes, If I didn't file any years or at least one of the last 3 years I didn't file, should I not put a checkmark and leave it blank right?

Also for when you put income as stated in taxes. do you put a note saying (see attached) or just 0 and then still put letter explaining why taxes were not filed?

I've read conflicting answers in the guides and forums so wanted to double check.

Always double check your documents and forms. Not only do you get delayed by RFEs and Checklists, but the time it takes for them to review the new items you send could be used to approve more applications. Save yourself and others valuable time!

Current Status: NVC:
-Assigned and Received NVC Case Number, IIN, and BIN April 18, 2014. (100% sure case # was assigned today because I called twice and it wasn't assigned in the morning when they opened but in the afternoon it was)
*Could not provide email then as case was still being updated in their system
-On April 21, 2014 I was able to provide my email and beneficiary's.
-On April 28 I was able to fill out DS-261
-On April 29 I received and paid AOS Fee (at 1pm)
-On May 1 I received and paid IV Fee (at 1pm [became available]), also AOS Fee shows as PAID
-On May 5 IV Fee shows as PAID and DS-260 became available and was completed. Also, AOS Package Scanned by NVC

-On May 7 IV Package Scanned by NVC

-On May 28 AOS Accepted

-On June 2 IV Accepted/Case Complete

-On June 11 Interview Email Received

-On July 3 Interview at Moscow

Note: Medical Exam scheduled after interview letter received by calling the specific clinic, earliest appointment was 2 weeks ahead)

-Visa approved, came to us, got greencard, sadly things didnt go well and divorced. Last I hears she was still in the US and got a full greencard (I notified USCIS of divorce though)

2 weeks is normally how long it takes for the NVC to answer emails.

Curious why you bothered to change addresses though as petitioner's current address goes on the I-864 and beneficiary's on the DS-260.

We updated the address by email because the lady we talked to at NVC told us to do so. At the time, we didn't have I-864 or the DS-260 available so that's what she told us to do. You are required by law to inform them within 10 days of moving, if I am not mistaken, so waiting for the forms was not an option...I agree though, it's silly but we figured we'd just follow directions.
