Does anybody know if I still have to file a AOS for my spouse even if he is not in the United States? The AOS process throws me off a little

I have Metro PCS. I only pay $65/ month. unlimited data/voice/text and that includes unlimited international voice to a landline and unlimited text.

We use whatsapp alot because its expensive for him to text internationally. He can receive texts for free so I usually send a message with a text an he jumps on whatsapp and continues the conversation,

you can check their website to see if your country Is included. There is no contract and they also have a "bring your own phone" program. I bought an unlocked Samsung Note from eBay and I ported it to Metro PCS

Dear Hoping,

If you send copies of tax returns (as opposed to tax transcripts), you must include your 1040, and ALL schedules (everything that was sent to the IRS), PLUS...

Copies of your W-2(s)

Copies of your 1099s

If you submit tax transcripts, you ONLY need the transcripts.

It sounds like your husband sent his 2013 1040 form, but did NOT send a copy of his W-2(s).

You have two choices: send the W-2(s) OR get the 2013 Tax Transcript (which might not be available yet)

Yes he submitted the 9pages i 864..he gave me the whole copy of aos he submitted bec.i told him to make 2 copies 1 is for the nvc and the other 1 is my copy..

OK...W-2s are how people usually prove their income from their job. If there is a lot of interest income, then that is why the 1099s are required. If only a little, probably not. Your checklist did not ask for 1099s.

So...why doesn't your husband have W-2s? It's not necessarily a deal breaker - for example, I was a partner in an accounting firm, and I don't have W-2s because I am not an employee. I am an owner, so I have what is called a K-1. If he is self-employed, there are probably other forms available.

If he just doesn't have a copy of his W-2s, his Human Resources Department should be able to get him duplicates. If he has a K-1, or some other kind of income proof, that is what the NVC wants.

Your tax transcript availability is dependent on several factors - first and foremost is: when did he submit his taxes? Did he file electronically (transcript comes soon) or manually/paper (transcript takes longer)? For Paper filings, the earliest they would expected to have transcripts would be June.

Ask your husband how he proves his income to the IRS.

I bought mine about a year and a half ago and couldn't be happier :) I just have it set up as a little mini web server on my desk, running my personal website (and my [possible future] immigration sub-site). Pretty awesome for about $75 :D (So much cheaper than my husband's server which cost him quite a few hundred dollars XD)
