there is no time limit, the faster you submit your documents, the faster things can get done.

For I-864, if you are submitting tax transcripts then you do not need to submit any other schedules or attachments. If you do not have a tax transcript, then you need to submit the whole tax filing package (1040, and all the schedules) plus W2 etc.

Thanks bkghosh. She used Tax Transcripts for 2012 and 2011 but for 2013 used 1st two pages of actual tax filing at HR Block. She however attached her current employment letter, pay stub ending February 2014, W2 and 1099 for 2013. Her income is not a problem.

Do we need to worry for getting a check list. I suppose NVC only needs to see if petitioner has sufficient income to support. Shall we resend I-864 with full schedules for 2013?

Last year Saylin recorded 88 case completes from members here. There are already 38 listed for the first quarter of 2014, so we're on track for at least double the number of cases to get through NVC this year. Given there are 220 pending members listed on the sheet I would guess it'll be substantially more than double. Obviously VJ is a tiny sampling of national cases and many people even on this site choose not to report... but basically, after the quiet of last year's backlog, NVC is getting slammed. Just good perspective for anyone getting started with the process now. I hope NVC keeps up those weekends of overtime!

It's really up to you, it's not as though they limit how often you call, so go for it if it'll ease your mind. For my IV docs scanned by NVC on the 25th, I'm thinking early next week might have good news. I plan on calling Friday night just in case, though.

I have read this before that the birth certificate must contain names of both parents but the certificate we get here in my place does not list the mother's name and I don't even think they will put the mother's name if requested.

Hopefully some others with knowledge of India will chime in on this one.

Unobtainable birth certificates

If your birth record is not obtainable for any reason, a certified statement must be obtained from the appropriate government authority explaining why your birth record is unavailable. You must also submit secondary evidence such as:

• A baptismal certificate that contains the date and place of birth, as well as both parents names (providing the baptism took place shortly after birth)
• An adoption decree for an adopted child
• An affidavit from a close relative, preferably your mother, stating the date and place of birth, both parents names, and your mother’s maiden name.

Note: An affidavit executed before an official authorized to take oaths or affirmations must also be provided. More specific information is available from the NVC.

I think it defaults to "no" on the form when you open it, but you want to select "yes" and provide the petitioner's information.

Do you know what kind of mail is sent to the agent? Is it just basic stuff like case complete?

I just don't want my husband receiving all kinds of mail from them as I will be doing all of the paperwork as the beneficiary.

Keep in mind, the number of people requesting to be on my spreadsheet went WAAAAAAY up the past 2 months! In the entire duration of my spreadsheet, I've never had this many people in the non-case complete section!

I received a checklist on my I-864 and the same for my joint sponsor.

The issue is with Part 6. Sponsor's Income and Employment, and specifically Item 13.a.1.

This is where you are supposed to enter total income as reported on Federal tax returns for the most recent three years. I attached transcripts for both myself and my joint sponsor, and I made the mistake of putting adjusted gross income instead of total income.

Who would have thought some tax credits for a few hundreds dollars would come bank to haunt me

My issue is now that I have entered the total income for both my own I-864 and my joint sponsors, I don't want to get checklisted again for the same item. Here is my situation.

My joint sponsor is fine, I corrected the adjusted to the total income in all three blanks (13.a, .b and .c)

With my own return, it is a little more complicated since me and my wife have filed jointly for the past three years. Total income on the tax transcripts includes her income as well. In Part 6. Item 5. I entered my individual annual income and had no problem and since my wife will not be working at her job upon moving to the States, for Item 10. My current Annual Household Income I entered the same as in Item 5.

So now the question is, in part 13.a. do I put my individual annual income for all three years or just write what is listed in the tax transcript as total income (filing jointly)?

I do not need to take my wife's income into account, and would prefer not to fill out any additional forms for her (I-864A for her) or translate her local tax returns since we don't need to take her income into account anyway.

If anybody has any idea what to do in this situation, it would be greatly appreciated. From searching, most people have indicated that the NVC phone operators aren't especially helpful and just tell you to read the instructions in this situation.

We had a similar issue with the joint sponsor and Saylin nicely gave us some answers. You need to put the total income (from the transcripts) and also send the From W2 to show your individual income. (we also put a letter to explain that the joint sponsor filed jointly with his wife but that his individual income are enough to fulfill the requirements as shown in the W2). Hope this helps!
