Hello Saylin,

I have filled my IV fees and status shows pending. DS-260 not yet appeared

1) Do I need to send filled DS-260 / confirmation page of DS-260 in the IV packet? If so then I need to wait

2) Documents [Original Birth certificate, Original Marriage Certificate, Photocopy of Biographic page of Passport, 2 passport photographs, Original Police clearance certificate] + Barr code cover letter + fee receipt. What else should be sent along with IV Packet???

3) Can I send IV packet before filling DS-260??

Spoke to NVC last night and confirmed our case was received on April 7. Funnily enough, our NOA2 hard copy arrived in Australia faster than our case shipped from NSC to NVC. Go figure.

And the waiting game continues...

did u get that from LOCAL POLICE STATION????

just want to make you aware that In India we get two types of PCC (one from Passport Office i.e. PSK and other from Police station), even i was confused which one to send in IV. But afterwards when i visited "reciprocity by country' link on USCIS website for India, it says (pasted below). Thus i got both PCC from PSK and LOCAL POlice Station, the one from PSK i have submitted with IV (they will issue 2 copies), and the other copy and PCC from police station i will carry along with me to interview.

As per my knowledge, PCC from police station is valid for 6 months but from PSK it is valid for 1 year.

Police Records

Indian Police Clearance Certificates should be obtained as follows:

  • All Indian IV applicants aged 16 and above, residing in India, should obtain police certificates from the local Passport Office.

Guys, i have filled DS261 on 27th March, and DS260 on 7th April, and they still show "COMPLETED" only, by what time i can assume them to show as 'ACCEPTED'. Both fee show as "PAID". AOS submitted, NVC received on 9th April, IV sent on 10th April.

Do you send an original I-864 to NVC or a copy and just bring an original to the interview? (I see that some send original and some copies)

And if you don't have a tax transcript, what exactly do you need to sent to NVC besides pay stabs and employment letter? Do you send in: tax form and W-2 or something else?

This thread is for filers that have been appproved by the USCIS and now are being processed at the NVC. You would benefit more by following a thread for the month you filed your I-130 petition so you can follow the process along with other files with similar timelines. Questions posted here are relating to the NVC process.

guys, I know this is beating a dead horse.... but I am on hold with NVC right now.. I want to verify the line item that is supposed to be used for the AOS . Line 22 is my TOTAL income.. Correct? My Friggin lawyer is using AGI.... which I know is INCORRECT... Before he sends out the package, I want to call him again and insist he use the TOTAL income as per the NVC instructions. He keeps telling me as long as the number is greater than the Poverty level for a family of 4, they won't kick it back. I barely slept last night because I am so worried I'll get a checklist...

Opinions please.... I know I'm probably koo koo for cocoa puffs for worrying but I really can't take this stress. The lawyer needs to do this correctly . ####### did we pay him for??

Yes I got it from Local Police station. As Per NVC, PCC from PSK is good enough. no where they mentioned PCC required from Police stations, For safe side I applied it. Also they mentioned PCC will be valid for 1 year from date of issue. I thinks it's both are valid for 1 year... ..

Okay I'm quoting myself but I just found this link on VJ about someone else in a similar situation and apparently you cannot file MFS or MFJ or married at all if you're doing e-filing when your spouse is a non resident without a SSN. So I'm assuming we're ok with my husband having filed Single.

Your assumption about "we're ok" is incorrect. You may NOT legally file as "single" if you are legally married.

This fact is correct: You cannot e-file MFS or MFJ or married at all when your spouse is a non-resident alien without an SSN. You must print out your return and file it manually until the NRA spouse gets an SSN.

While the IRS may accept the return filed as single, because the IRS does not share information with the USCIS or NVC about your marital status, it may cause the NRA spouse serious grief at the interview, and, in subsequent years, cause the couple great grief with the IRS.

Your husband will need to amend his tax return. You may get through your interview just fine - or you may not. Just get him to go ahead and amend his return now so you can demonstrate that he understands his mistake and is trying to correct it.

Remember, it would be VERY rare to find an accountant that is fully versed in immigration law, just as it would be very rare to find an immigration attorney that is fully versed in tax law.

I got check listed for this! Good catch, you are right about the need to use total income. In my case, it was a difference of only a few hundred dollars because of a self-employment credit but I had to resend a corrected I-864.

You need to put the TOTAL INCOME, unless you are sending in an 1040EZ and then you can just the adjusted gross income.

They "kicked it back" in my case, so it is important to double check.

You can't stress about check lists, because you aren't in control once the documents leave your hands and sometimes the NVC finds problems where they don't exist. Do your best, fill in everything as instructed and good luck.

That's coming from me, who just got a checklist because of a NVC mistake.

Whaaat? Can't they just read their own instructions? I am in the same situation (studied abroad for 10 months). Hope this was a mistake that will be fixed quickly for you, and that we won't get checklisted... You could file for an expedite because it is obviously a mistake but as they take 2 weeks to process the emails I am not sure it will help. Please let us know what happens and best of luck!

So I actually called NVC immediately after getting the e-mail, so at close to 1 am in the morning European time.

The operator told me to send back the checklist with bar code page, and a letter explaining the situation and that it was most likely a mistake.

I double checked the DS-260 that my wife submitted, and it is clearly 10 months that she was residing abroad.

So I didn't really want to 'get back at the end of the line' and wait for them to receive the letter, process it and then wait the additional 20 to 30 days... so I called the NVC today again.

I got a helpful operator, explained the situation again and she said she would just enter a note in the system to have a supervisor review the checklist as being issued incorrect and to remove it from my file.

She said that it could also take a few weeks for supervisor review, but that it could be faster. She said not to send the checklist with barcode sheet in, since if I did then they would wait to review my file and input the new information when they receive it.

Glad I called, since hopefully the supervisor review will be faster than if I had to send a letter, wait for it to arrive, process, and be input into the system.

Your lawyer sounds like a idiot. If numbers are not correct they will kick it back you know this and I know this. I am surprised he doesn't know this.

Thanks for the update! I am happy they realized their mistake and hopefully the supervisor review won't take long! I wonder if when sending the packages, we should insert a copy of their own instructions with highlights, just in case they forgot them! :bonk:

He is a US citizen, lived in the UK, now moved back to the US. I am French, we met in 2010 in the UK and got married in March 2013 in France.
