I know this issue has come up many times..but im still confused even after reading saylins wiki..

My husband is a born USC..he came here to india in 2010 on a visiting visa..he's been here since then due to some property issues..we got married in april last year..my husband is the petitioner and my father in law is the only joint sponsor..my husband left his studies and job before coming here and so his income is zero as of now..he is still here in india with me..

My question is..

1.does he need to prove his domicile in the US even if he's just here for visiting purposes?

2.if he goes back say tomorrow..he doesnt need to prove his domicile anymore?

3.can my visa be declined on the domicile issue even though my joint sponsor is very well estabilished financially?

Help please .

If he is in India since 2010, he will require to prove his domicile in the US. Although I am not sure how will the consulate find out that he is in fact residing in India for last 4 years.

Im waiting for the NVC case number and the thought of amending tax returns with waiting of 8-10 weeks just kills me.

My spouse filed as single and i realized the mistake and was thinking of getting it amended to MFS,but is there a quicker way of getting it in hand?

Don't we have to wait for at least 8-10 weeks before sending AOS packet since we have to include the tax returns in the package.

I am not sure why you think amending the tax return takes 8-10 weeks. Amending is submitting one form (1040 X), you fill it in (MFS) write NRA in the box where you would otherwise enter spouse's SS#, mail it in and you are done. Later on after your spouse is here and he/she has the SS#, you amend the return again (MFJ). This time you will get an additional deduction and hopefully some money back from Uncle Sam.

what does it mean?

it mean they received the package or does they approved?

i just sent my AOS 3 days ago.

should i call and find out if they received mine or do they update in payment center web?

If you sent them AOS package 3 days ago maybe you should start calling them next week to find out if they have approved it. They do not show the approval on the CEAC website, nor do they send you any email.

Same with the IV package. Only when you call, you can find out.

I was in the assumption that if we submitted the 1040 X form then we couldn't submit the original tax return(with the single filing) for AOS.

I suppose il submit the Tax returns (with single filings) to NVC and in meantime do the amendment(1040 X) and provide it during interview if ever required.

1. They probably want the ones before your current, but I don't think you'll get a checklist for putting down your current again.

2. I plan to put down the name of the company when I worked for them. The only way they can really track this is if they can access my Canadian tax information, so I want to make them match up.

3. Again, I plan to put down the address/contact info that was current when I worked for them.

4. Put down their names if you know them, or click "don't know" - shouldn't matter.

5. Did you have a permanent mailing address? (your parents' house or whatever?) if so, put that. Otherwise, I'm planning to put down the addresses from which I filed my taxes for the times that I was living in company housing or temporary accommodations.

This is just my best guess, but I've been concerned about the same things and plan to be as honest as I can, within reason. And I don't intend to track some franchise restaurant from 1988 that's been out of business for 15 years. (and for which I have no idea what my supervisor's name was! I mean, really!)

Question please, I hyphenated my husbands last name to mine and was going to send the change to USCIS but it was accepted the other day and I'm sure it's can't be at NVC yet. So question is do I send them the change showing my license and SS# change when they finally get my case and I get the case number or should I risk it and call USCIS in case it's still there and try to change it via the phone? Also If send it to NVC will that delay anything or is this just a simple thing?

My husband will be moving but in the same country and city he lives in now. Will there be a new case number for this kind of move also. Just not right they should make you wait because of moving.

I'm on hold with the NVC on the phone right now.

Just got another checklist, this time for my wife's IV packet. More frustrating than for my AOS checklist, since there I made a mistake; this time they made a mistake sending this one out.

They want a police certificate from my wife for a country she studied abroad in for 10 months, even though their own web-site is pretty clear about only requiring police certificates from foreign countries if you were resident there for a year or more.

Hopefully the operator will be able to help out in this situation, without putting us back at the end of the line again for processing. If they make us send this police certificate, it will take at least a month to get the thing at the embassy or by mail without counting the time and cost (plus mailing it to the NVC)!

Whaaat? Can't they just read their own instructions? I am in the same situation (studied abroad for 10 months). Hope this was a mistake that will be fixed quickly for you, and that we won't get checklisted... You could file for an expedite because it is obviously a mistake but as they take 2 weeks to process the emails I am not sure it will help. Please let us know what happens and best of luck!

While we are filling out the online form DS-260, we realize that under the tab "Work/Education/Training" (one of the blue tabs on the left hand side), our form only has two items: "Present" and "Additional". The item "Previous" is missing. Without the "Previous", we are not able to input any previous jobs and educations information to the form.

I called NVC about this problem. They login to our DS-260 form and they also see the item "Previous" is missing. They said that the item "Previous" should be there under that tab, but they keep telling me that NVC is not able to fix this problem and they do not know who can fix this.

Does anyone has this same problem? Anyone knows how to solve this problem?

Hi, we had the same thing. I wasn't too worried and thought it was maybe because I was still a student... We had no "previous" questions for neither education nor work. But now you got me worried! Let us know! ;-)
