Ds-160 form, 'refused a us visa' does l1b count?

Hi all,

I am filling out my ds-160 form and I am looking for help on the question 'have you ever been refused a us visa'

In June 2012 we applied for a L1b visa, which was rejected as my skill level was insufficient. It didn't get to the consulate or interview stage, let alone POE stage, so do I answer yes or no to this question?

If I were you, I would answer "yes". Your application is already on their records. Whether eventually it wasn't reach the interview stage or PoE, it does not matter. The US embassy in Jakarta did not directly refused my B-2 visa in 2010. They were supposed to give me a pink paper as usually for a visa refusal but they just handed me a yellow paper stating " filing petition for K-1 visa", instead. I was then put have been refused B-2 visa on my online DS-160 form.

That's my two cents.

So since I never received anything personally, do you think this would be an issue at interview?

Previous refusal would not affected the approval of K-1 visa unless something else occurred, for instance, they caught you were lied on the application before. Misrepresented documents for the immigration purpose is unforgiven.

I spoke with our lawyer yesterday who said it was nothing to worry about and I should answer 'no' as it never got past USCIS, I was refused L1B status, not an L1B visa, as that specifically refers to consulate/NVC levels, not the initial uscis stage.

And no nothing else occurred. Since I was rejected, I have travelled twice to the USA. No questions asked.

Do not put "No". it will just raise eyebrows. I was refused Visa and i did answer " Yes".

P.s explain them what was the reason and how you didn't have right level of skill set. Good Luck

Were you refused an L1B visa?

I already had submitted the ds-160 form by the time I received your reply. Can I submit a new one by bringing it to the interview? The signature page of the ds-160 form does say 'the information within this document is submitted to the best of my knowledge and in good faith' which is true after all.
