Called USCIS, they said my case is denied.HELP

So you have been in a same kind of situation before? Or how do you know all this?


I mean same situation that we are in right now.

4/30/2014 AOS/EAD/AP mailed
5/1/2014 USCIS received our papers
5/6/2014 NOA Date for all my applications

5/29/2014 Biometrics done in Detroit
moved to Minneapolis, MN June 10th
6/10/2014 RFE regarding my birth certificate(It was their own mistake, my birth certificate was exactly what they need)
6/11/2014 RFE response mailed to USCIS by our lawyer
6/11/2014 I-485 status moved to Initial review after telling USCIS our new address
7/2/2014 I-485 status moved to Testing and Interview

7/21/2014 EAD to card/document production yayy :)

7/22/2014 AP status chagend to post desicion activity

7/25/2014 EAD combo card mailed

7/29/2014 EAD combo card arrived at my old address(address was changed TWO times before that, even by my lawer and USCIS still had my old address)

-my parents-in-law are sending it to me overnight

Travelled to Finland with my husband for 3 weeks in August. Came back with my Advance Parole, POE in Chicago, no problems with AP.

10/7/2014 Interview date

10/8/2014 I485 status moved to card/document production! HAPPY :)

My recollection is that they reconsider, not consider new information.

Is it even possible to reapply? I didnt see anywhere on the letter that said we could start over again and reapply.

It is most definitely possible to reapply, as I stated earlier. I am not that familiar with motions, so I have nothing to add on that front. Best of luck to you.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Ok, thanks for your help everyone!

We are probably going to reapply for my AOS/AP/EAD and not file a motion.

Do I have to get a new criminal record from my home country? Because my last one is from september, from right before I came to the US.

And also, my medical exam is from August, does that still work?

Does anyone know, if I can expedite my AP and EAD, since I have already been in the US for 6 months. I know it's our own fault that it's taking this long, but is there any way we could get my AP faster?

This time we will have to be really careful filing, maybe we will post here our "checklist", and if someone would be willing to help, that would be awesome! :)

You don't need a police cert and didn't need one the first time :)

Your medical is good for a year so should be good still.

You could try for EAD expedite. You'd have to have a reason, so check uscis.gov for expedite requirements. A pending job might do the trick.

I do think you'll need to get another biometrics (and pay), but I am not 100% sure.

Are they going to know that I already applied once and got denied, should I explain the situation to them on a letter with my AOS package?

Your K-1 expiration doesn't matter. They will still accept it. You could mention it in a cover letter but it's not needed.

Your K-1 visa was invalidated at the border crossing,

and

it was the I-94 that governs your legal stay.

If'n you got married within those 90 days after arrival,

then USCIS won't care when you file the AOS set,

except if it's more than 2 years, you add in an I-130 to the set.
