Vendar, the infopass idea is a good one. Also, many lawyers give free consultations. Just call around till you find one. I am sure that this happens a lot. Don't despair. I know you're upset but this is something that you can overcome. Let us know how it goes!

Immigrating to Finland...not a bad idea. Viisumi matka.com?

OP...best of luck to you. Seems you have tried to figure things out and have had a bad dose of luck. I also understand having to pay the roughly $1,000 in additional fees isn't easy either.

Best of luck to you!

So, I'm going to ask this, but maybe it's a stupid question. I am a student, and get very little, but I always get 1098T form (for fellowship/scholarship) for taxes and I still file everything, even though that's not my "payment" it is not like a W-2. And of course, I never ever had to pay taxes afterwards, as they always saw that I'm getting a fellowship and no real payment, since I'm a student. Maybe the problem could be here, that your husband just never even submitted anything to IRS? I am not sure, not saying this is exactly why you got denied. But maybe it's worth to check into. Writing a word document that I'm a student and hence my payment is so low I don't have to pay taxes might not be convincing to USCIS. Some sort of proof "Evidence of employment", or a letter from the school how much he is getting, or a W-2 if he is getting that, or simply the 1098T form from the school. Peeps, chime in if I'm way out of line here...I have no idea. This is just what I've been doing and I had no problems in the past anywhere including when me and my spouse were doing AOS. All the best whatever you decide to do. Sounds like your husband would be fitting in very well in Finnland, so at least I'm not nervous on that part. :)

These people are not experts, She said she does not have the RFE.

Yes, this could be something that went wrong!

I am really thinking about the Finland option, now that we are married my american husband could just come to finland and apply there for a residence permit. And stay there while it's being processed. The only thing is that my husband has one year of school left here, it would really be annoying to live apart for one yaer, but of course we would visit. But still...

I will let you guys know when I get the letter explaining why my case was denied.

Thank you.

Please read the whole thread. I told what my RFE was about, I do not have the details of what they requested, we were stupid and didnt take a copy of the RFE letter because we had to send it back to the NBC.

since yer sitting there with gear and an available telephone,

I suggest you call into USCIS again, get an ISO,

and inquire about stuff [see my last post here on what to ask about]

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

I called USCIS, they transferred me to the next level, the only thing they say is that they did receive my response to the RFE and my biometrics in january, and now all my cases have been denied on the 27th. I have to wait to get a letter explaining what to do next.

OK - I think it was the FIL's tax records that hosed you,

but :

1. thanks for calling in ! and

2. wait for the postal letter.

is possible an RFE was issued and you never received it, then the RFE deadline was past,

then USCIS auto-denied it for you failing to comply.

I suggest you call in again, ask for an ISO, a Tier 2 Human,

and :

1. ask if an RFE was issued and

2. ask if any returned mail pieces on you.

then report back here, when yer able.

Dealing with a CSR, the first human that answers, is a waste of time. You must ask to be transferred to an ISO, a Tier 2.

But unfortunately Tier 2's are not always helpful.

I know, right? That's why it takes multiple attempts, as even Tier 2's not handle the stuff they are supposed to handle with 100 percent 'engagement' levels.
