im sending 2012 taxes for aos since is so close to april 15 deadline should i apply for a 2013 tax extension or just send 2012 taxes without it (ihavent filled 2013 taxes for a reason dont tell me to do that).

If you are going to file for an extension, then go ahead and do that before sending off your AOS paperwork and include proof you filed for an extension with your I-864 documentation.

since irs wont give extension application confirmation can i just attach a copy of the extension application?

Yes, provide a copy of the extension you file and point out to the USCIS that you have filed an extension for 2013.

just provide the tax extension copy or an explanation as well ?

On the place where you are to enter the Total Income from your 2013 tax return, write in Extension Filed and include the extension copy. You can write more of an explanation if you wish though.

it says most recent year not 2013 since my most recent year is 2012 thats what i put is that ok idont want a rfe

Yes, that is true Thanks for the correction. Since you didn't file yet, 2012 is still your most currently filed return. I must need some evening coffee. See, you know all this stuff now

Add a statement with the extension about why 2013 is not filed as of yet.
