visa on hand! but USC husband doesnt want us to leave!

Finally I just received my IR visa last saturday! I am really excited for me and our toddler to go to US and live with my USC Husband. We should leave by july because visa will expire on july13 2014 but because me and my husband have so many marital issues and we've been arguing alot he decided not to buy us ticket to go to US because he reasons that he has no money but i dont believe him cos if he really wants to take us to his country he would do everything to make it happen. My question is..if already have money to pay for the ticket can i and our toddler son

Still go to US even if my husband doesnt want? I already have visa and our son have his US passport.?

If you have an IR-1 visa, yes you can go to the USA without your husband. You will face the questions Belinda pointed out though And one has got to ask why would you want to?

If you have a CR-1 visa, I think you'd run into serious problems when it came time to remove conditions, as it would greatly appear you got the visa not to be with your spouse but to get around the other immigration laws.

Thanks for the advise. I actually have my own savings and assets even before we got married and i have friends there too. My thinking is maybe if we land in the US without his help he would somehow change his mind. :(

Whats up with him,supposed to be he should be excited that You come over to join with him but it seems like he is not. He must think of it how far had you been goin through with all the process. So many are they get not lucky at time of final round so Be it. You need to confront him again beside any other reason,

Like we did after we received the packet 2 days after we fly out right away has no any reason in myself to have them taking so long to go with me whenever takes to be we can find a way. I'm so lucky that i have friend who are willing to loan me some$ cost a hundred thousand pesos in php currency but nevertheless its worth it no matter how big or expensive it is. Nothing could be replace to it when it comes to your family matters.. i know someone who can understand ..

I just realized he's actually still in the USA, so it makes a bit more sense to me. Living in the USA is very expensive, so it might be he is having a hard time coming up with the funds to buy the tickets. The entire visa process can be very hard on relationships to. If he's doubting the relationship, the claim of not being able to afford the ticket might just be an excuse because he's worried he made a mistake. One could put a ton of reasons why this happening now, and likely be wrong on most of them.

I'm not sure if just showing up is the greatest idea, maybe if you said you've got the money for the tickets his mind would change? I don't know, just thinking out loud with that comment, but I'd be concerned his reaction is not going to be that good if you just show up in the USA and move in with friends. If he's doubting now, that might just confirm in his mind it was all about getting to America and not a real marriage.

He's had plenty of time to save up the money. But, since you have your own finances and friends in the US, you shouldn't have a problem making the trip. However, as others have indicated, you'll have an issue when it comes time to adjust status if you and your husband can't work things out. Sorry to hear that you're having a rough go of it.

The very long time that it took for you to get your visa may have played a role in what's happening between you. The long and drawn out process is frustrating. Hopefully, as you said, he has a change of heart and mind.

That's what surprises me to. When my wife got her visa, I couldn't wait for her to arrive I was so excited. Either he is really hurting on the money side, or something has really gone sour in their relationship from his point of view.

She stated IR-1 visa, so there is no Adjusting Status or even Removing Conditions as long as its really not a CR-1 visa. She'd get a 10 year green card on arrival.

Yes, you and your son can go to the U.S. Your son can stay in the U.S. because he is a U.S. citizen. You can stay in the U.S. because you have an IR-1 visa and will be issued a 10-year (permanent) green card.

If you are not going to live with your husband, you will want to notify the USCIS about your change of address.

It is actually hurting me that my husband doesnt want to take me now to US. He says he loves our family but he prefers to live in the philippines cos its much cheaper. We have a condo unit that will be finished soon this year and he's excited more excited to move in there with us than going to US. I just want him to take us to his country so i can meet his family so they can also meet their grandchild. I love my husband so much but sometimes i feel he is testing me cos i have been obeying and doing what he likes. He visits us here 3 to 4 times a year.
