Hello all,

My father in law is sponsoring our return to the US as a joint sponsor. He meets the income requirements by a comfortable margin so no issues there, however i have a question about completing the i-864 form.

We are using ONLY his income, however his tax returns are jointly filed with my mother in law. Since tax returns are used as evidence, does she HAVE to complete a i-864a in addition to the i-864 he completes? Or will they be able to separate it all when they review the join tax return?

I hope my question is clear. If not, I'll elaborate as best i can.

when it asks for his current income, write what his current income is (for example, the number written on his employment letter)

when it asks for total income: write the line for total income from his tax transcripts. (this number in reality includes the income from your father in law and his spouse, as they filed jointly. this doesn't matter. the form asks for total income, which is what this number is).

your mother in law doesn't have to fill out anything if she doesn't want to.

Thanks for your response, very helpful.

May i ask another question?

When my wife completes her sponsorship form, does she include her current salary/earnings here in the UK or is this not eligible as it will not be relevant when we move to the US to 'support' me? May seem silly, but thought i should be sure, Obviously she will be giving up this job when we move.
