It's been more than 2 years to our marriage and we still haven't gotten our greencard. I am wondering, whenever I get my greencard, wouldn't it be a permanent one since it's been more than 2 years for our marriage? Or would it be a temporary (conditional) one and then I could file for the permanent one right away? Any input?

You haven't gotten a green card and it's two years since you married? When did you apply? The first green card is a temporary, good for two years. The second, the so called permanent card is good for 10 years and must be renewed every ten years unless you become an American citizen.

If you have been married for more than 2 years at the time of your interview you will get the 10 year GC. It looks like you have been waiting awhile without any news. Have you had the interview? Do you know what is holding up your application?

Yes, we got married and filed in September of 2004. It's the infamous namecheck that's been holding our case. No interview, no fingerprinting, no biometrics...it hasn't even been touched since we filed it. My case would perhaps make everyone feel better, huh?

If you have been married for more than 2 years at the time of your interview you will get the 10 year GC. It looks like you have been waiting awhile without any news. Have you had the interview? Do you know what is holding up your application?

You should get the 10 year card. When you finally get an interview you might want to remind them of this.

I have done that several times, to the point where they now nicely said "don't come back here again please". I wrote to the local congressman and everything! No definite response.

I think you should make an infopass appointment to see what's taking so long, without biometrics and without interview? That's way too much time.

Most DEFINATELY remind them of how long you have been married when you go to your AOS interview....When we were at our interview, the lady interviewing us had asked us all the questions we needed to and said she was finished and that we could leave. I then asked her if I was going to be eligible for the ten year green card as we had been married just a little over two years at the time..She opened up her paperwork and I saw her scribble something out and write something new down, and she said...."I see, yes, you have been married for two years."...................I doubt they would have caught that if we hadn't brought it to their attention...There ain't no such thing as a stupid question!! :lol:

AOS was officially approved via email notice from USCIS on August 10th/2005, 622 days from the filing of the I-130 in Nebraska on November 26/2003, the very first day that we started our immigration journey.

I know its not in the trash :) I just received "another" letter from them yesterday about my AP - basically asking me not to contact them for 6 months! They say it in nice words though: "If you don't hear back from us in 6 months, please call the Customer Service Center."

I just looked over your timeline and it is very weird- AOS, EAD and AP all delayed? I'm wondering if your file ended up in the trash!
