Hi! I just recently booked my flight to the philippines and I'll be traveling next week for 3 weeks vacation. I worried about travel documents. Upon reading it it says that I have to apply for I-131 permit to reentry to US.

My concerned is I'll only be gone for 3 weeks. Do I really need to apply for I-131 before taking my trip and in order to re-enter US? I'm under conditional permanent resident.

Please help me.... Thank you!

As a CPR you have a GC correct? The GC allows all LPRs to be re-admitted to the US as long as you do not remain outside the US for more than one year at a time. Any trip less than 6 months gets little scrutiny unless this is one of several trips in the last year that causes you to have been out of the US for more than 6 months. Trips between 6 months and a year can be looked at and there is a small possibility that you could be denied re-entry to the US, but that is fairly rare. Just remember that you are a LPR of the US and are bound by the rules and responsibilities of a LPR as outlined in the code of Federal Regulations (CFR). You may want to have a look at the USCIS website and read up on being a LPR so you do not end up loosing that status.

If you do not have the GC yet, then you do need the I-131 advance parole (AP) in order to re-enter the US and I am afraid you will not receive it before your trip. You could make an INFOpass appointment to see if you can get proper documentation in order to travel if your GC is pending. I am assuming by your statement that you are a CPR that you have the 2 year GC in hand.

Good luck and have a good trip,

Dave
