My wife and I are about to file the I-864 file but looking at the step-by-step instructions there's one big obstacle; my wife is not domiciled in the U.S.

We've been living together in Scotland for almost 2 years now. The only exception I can see being plausible is the one in part 4 (: "You are living abroad temporarily". I'm hoping that my wife's "Limited Leave to Remain" marriage visa will come under "proof...that a foreign government has authorized a temporary stay". I called USCIS and was given the advice "I don't know, give it a try anyway". I was wondering if anybody has had to deal with a similar problem and if they were able to get around it in a similar way. I really don't want my wife to have to go back first without me as it's important to my family that we're both here until I get my visa.

Use her Parents or Siblings address.

You are going to need a co sponsor most likely, who ever will be doing that.

We've been using her dad's address for the entirety of the visa process and he is also going to be our co-sponsor, do you think this will suffice?

This is what we plan to do as well.

I've been in the UK on a LLR visa for 18 months. I don't have any property in the US, but I do still have a bank account. I'm hoping that will help a little. We will also be using my parents as co-sponsors.

I can't imagine how others would do it any other way! If you're doing consular filing in the UK ... the only way you can qualify under their jurisdiction is to be a "resident"!

How very confusing!

  • January 15 2005 - Met Online through HotorNot.com (haha, I know)
  • April 17th 2005 - Met Face to Face
  • April 24th 2005 - Got Engaged!
  • June 21st 2005 - Theresa Moved to England on Fiance Visa
  • September 3rd 2005 - Married in Harrogate, UK
  • January 28 2006 - Limited Leave to Remain Granted
  • October 20 2006 - Gave birth to our beautiful Son
  • January 2nd 2007 - Mailed I-130 with USCIS London
  • January 5th 2007 - Credit Card Charged for $190
  • January 10th 2007 - Notice of Reciept of Petition
  • January 20th 2007 - Received 7 boxes to fill and send on the slow boat
  • February 2nd 2007 - Signed lease for our house in the US
  • February 28th 2007 - Moved out of our house to stay with Parents until we leave!
  • March 2nd 2007 - Flight cancelled due to Blizzard Conditions in Minneapolis!
  • March 3rd 2007 - We entered the US in MPLS with Visa Waiver for 2 Months
  • March 26th 2007 - I-130 Approval Letter! Hurray!
