Hi everyone,

Today is day 35 since USCIS received my packet and according to the website, I am being sent a second request for evidence. The first one was sent 2 weeks ago and I sent the W-2s they requested, as well as 2013 tax transcript for me and my wife.

Could any one speculate what this second RFE may be for? I know I'll probably get it in the mail in this here week but I'd like to know what experiences other I-485 applicants have had with multiple RFE's.

Secondly, how much of a setback is a second a RFE?

Did you send the full transcript or just the 1040? Does the petitioner's current income exceed 125% of the poverty line for their household size? Has the petitioner's income been steadily above 125% of the poverty line in recent years?

An RFE for initial evidence restarts any counters or things like processing time for your EAD/AP if applied for and an RFE fort further evidence pauses that same counter, which would in turn delay your I-485 application.

I sent the entire transcript like we got it from the IRS. I also sent 1040 and W-2's. Her income hasn't consistently been above 125% because she was in school up until summer of 2013. Her 2013 income was actually just a tad over the FPG. Do they want your income to be significantly above 125% or is exactly 125% enough?

If I had to guess, it would be a second RFE for the same stuff. They can deny you for improperly responding to a RFE, so I'd consider yourself lucky that they gave you a second RFE instead.

Did you include proof of current income?

When you get the RFE, come back here and let people look over it and make sure you respond with the right stuff. Good luck.

Hi,

We also had two RFEs. In our case, the second one was unrelated to the first one, and we responded to it the very same they we got it in the mail. Overall I don't think it delayed our processing time too much. You can check out my signature for details. Good luck!
