I acquired U.S. citizenship a few years ago. However, I only received my certificate of naturalization but not a form N-XXX(petition for name change) even though I changed my name at the same time. Now I need a copy of the form N-XXX to show that I changed my name legally. First, I went to the county clerk's office, but mine is missing, not there. And they said the reason why they do not have it would be that the immigration office did not send them. So I should check with the USCIS. I called the USCIS information and they do not even recognize the form N-XXX. On top of that, I couldn't make an information appointment online, because it's not available. I'm going nowhere.

So I need some help and have some questions:

(1) Who keeps the petition of name change forms if it was done at the same time when applyed for citizenship?

(2) Do they keep it together with the certificate of naturalization?

(3) Can I go to any USCIS field office to get access to it?

(4) How do I get a copy of the form N-XXX

That's the problem. It's not that I filed a petition for name change in court separately. So I don't know which court to contact.

The court where I had the naturalization ceremony do not have a copy. The country clerk office confirmed it.

I assume the USCIS shoould have a record on my certificate of naturalization and the petition of name change,

but USCIS doesn't even recognize the form N-XXX.

On the application form that you fill out to start the process, you can check the “yes” box when it asks “Would you like to legally change your name?” That’s on page 1 of Form N-400, “Application for Naturalization.” It then simply asks you what you want as your new first, middle, and last names.

If you didn’t request a name change on that application, but haven’t yet taken the oath that makes you a citizen, it’s still not too late to change your name. You can fill out a simple “Petition for a Change in Name by an Applicant for Citizenship,” and submit it before the ceremony. It’s Form AO 115 at the Federal Court’s form web site: http://www.uscourts.gov/forms/uscforms.cfm.

It looks like you can file the Petition at your citizenship interview. But to be sure, ask ahead of time with the people who naturalize you, the U.S. Citizenship and Immigration Services.

Whatever way you request a name change in the naturalization process, it can only be done if you take the required Oath of Allegiance from a judge, at a ceremony in court. Which means you CAN’T change your name is you take the oath “administratively”—when it’s administered by some other official.

Your new name will be on the written Oath that you sign, and be the name you use when take the oral Oath. Your Certificate of Naturalization will bear your new name.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
