Clarification on required docs for Joint Sponsorship please!

Hi all,

So I've looked through other threads related to joint sponsorship for K-1 visas, but still a bit confused (sorry to be dense :huh: )

I, the petitioner, am currently a graduate student and therefore do not meet the poverty threshold for sole sponsorship. My parents, who largely surpass the threshold, are happy to joint-sponsor.

My parents have provided 1) Form I-134, completed and signed 2) Form I-864, completed and signed.

It is my understanding that I, as the petitioner under the poverty threshold, provide my own Form I-134. Do I also need to fill out the I-864?

I would be grateful for any advice/insight from those of you who have encountered this situation. Thanks in advance for your help!

Discard the I-864 forms. They are not used until adjusting status after marriage. You and your parents each provide an I-134 and supporting financial documentation. Additionally, your parents provide evidence of US Citizenship or Legal Permanent Resident Status. This can be photocopies of US birth certificates, Naturalization Certificates, passports or green cards.

Discard the I-864 forms. They are not used until adjusting status after marriage. You and your parents each provide an I-134 and supporting financial documentation. Additionally, your parents provide evidence of US Citizenship or Legal Permanent Resident Status. This can be photocopies of US birth certificates, Naturalization Certificates, passports or green cards.

Ah ha, that's the difference between the I-864 and I-134...

I am in a very similar position (about to enter grad school and mother will be co-sponsor). I am right now filling out the I-129f.

Am I correct that I do not need to submit the I-134 until later on (after NOA1), so that my fiance has it when she goes in for her interview?

I have read the guides as well, but it is a bit overwhelming and I keep mixing things up in my head.

I completely hear you, it's an overwhelming process!

Having already gone through the petition phase (I-129F with USCIS) I can tell you that you definitely don't need the I-134 until after the NOA2 (petition approval).

From there, according to other helpful VJers, you'll need I-134s from both you, the petitioner, and your co-sponsor (yay for supportive mums!) for the Embassy phase.

Afterwards, during the Adjustment of Status once you're married and living together in the States it seems that you (and again, your co-sponsor) will need to submit a different Affidavit of Support ( I-864).

To the best of my understanding, that is...I can at least vouch for the first phase!

Don't overcomplicate this! Form I-134 is required from you as USC and another from your co-sponsor, with both supported by documents such as pay stubs, tax returns, letter from bank etc. The consulate only want to know you will not be a public charge during AOS phase.

I don't see any guidance which states you or your co-sponsor must prove US citizenship/LPR/naturalisation etc together with this form (birth cert, green card etc); you will have already proved this during the K1 petition (ie. pre-NOA2).

I surprised her with a proposal in Los Angeles, and this is how it went down!

That you don't see it does not mean it isn't required. A petitioner does not provide evidence of US Citizenship or LPR status with the affidavit because that is established as part of the petition approval. However, a "co-sponsor" (not an actual immigration term but a tool used here of VJ) MUST provide such evidence with their affidavit.

My fiancé and I were just approved at the USEM in Qatar using a co-sponsor, and co-sponsor proof of citizenship was listed as a requirement on the Packet 3 checklist (see below). We submitted a copy of my mother's (co-sponsor) passport.

Of course every Embassy has slightly different requirements, but I would definitely be prepared with all potential docs!

If the petitioner’s income doesn’t meet 125% of the HHS Poverty Guidelines

a Joint Sponsor must provide the following requirements:

Affidavit of support I-134, signed by the Joint Sponsor

Original current job letter from Joint Sponsor, to include effective date on company letterhead

(If employed)

Copy of tax 1040 for recent year

W2s for recent year, or proof of source of income if self-employed

(Include business licenses, rental and/or lease agreements as appropriate)

Proof of Citizenship or Legal Permanent Residency

(Copy of passport, naturalization certificate, U.S. birth certificate or green card)

I see somebody has verified this for you. Bless them for doing so. I've been doing this for a while now. If I had to document all the answers I give, I wouldn't be providing nearly as much service here, but If I state it as a fact, you can take it to the bank. If I don't KNOW, I don't respond. I also seldom respond when "EVERYBODY" knows because I'm not needed for those questions. Send a passport copy, US birth certificate of copy of green card with any co-sponsor's I-134.

Thank you. I asked for guidance only because I see no reference to this requirement anywhere else, so its surprisingly new information to me where i've been very thorough in learning what I have to present.

I've raised this in another thread and it has been suggested it may be a consulate-specific request. For me in the UK, there is no guidance asking for proof of citizenship with the I-134.

And perhaps you will never receive any guidance about this until the visa is delayed due to its absence. Provide the evidence and you will not have this problem. For many of us, this ain't our first rodeo. For me, it isn't one of my first 200 either. I'm here to help, not cause unnecessary work for you.

You're saying the consulate only needs to know I won't become a public charge? I'm asking because this whole thing makes me scared something will go wrong. It's probably me being paranoid, I don't know. We just got our petition approved and I'm assuming the next step is me doing the physical in my country, gettin documents ready and going to the interview.. My fiance has a child claimed on his taxes so his income isn't enough to provide for three people... That's why we need a co sponsor and my fiances sister is willing to do it. She has a very good job and never claimed anyone on her taxes. Do you think they will not have a problem with this? I mean it'll be obvious to them that my fiance can't do it cuz he isn't making enough for three people... I'm somewhat afraid.
