Hi!

My 2-year conditional green card is set to expire by the end of October. Thus, I cannot file for removal of conditions until the end of July.

I would like to travel abroad in late September, returning before the end of October. This means I will return with a green card which expires in less than one month.

Can I safely do this and file the removal of conditions at the beginning of October?

I am afraid if I file by the end of July that they will invite me to biometrics during my trip abroad in late September.

Hi!

I was in a similar situation. My wife and I traveled abroad and returned with only 15 days left on her GC, and then filed for ROC with only 11 days left. We haven't received NOA1 yet, so I'm a little nervous since time is running out, although I know they received the application with 10 days left to file.

Anyway, I had the same question. I don't think immigration will give you any problems when you re-enter, if the GC is not expired.

And my reason for not filing before our trip is the exact same as you, I didn't want a biometrics appt or an RFE when I was gone, as I don't really trust anyone to check my mail and inform me of anything like that.

I'll add one more thing, I don't suggest doing this because if you are like me, at least, it will make you worry too much. I haven't been able to get much sleep since I mailed our I-751. But if you have nerves of steel or you have a very important reason for traveling(we did), then as long as you get it to them before the expiration date, you might be ok. Again, I can't say yet, since I haven't received anything yet.

No problems about entering with a green card about to expire, I just came back from my home country yesterday and my green card expired today. On the other hand I would advise you to wait to file it, I just missed my biometrics appointment because I was abroad when The notification was sent :( I sent my paper work on feb 18 and got the NOA on feb 28th and I had my biometrics appointment scheduled for March 25th which I missed :'(

I agree with the other posters but would add that, if you file late July you should definitely receive your appointment letter before you travel. At that point, if the appointment is during your trip, you can either reschedule or attempt an early walk-in.

I will actually only be on vacation for one week. I am thinking of just putting my vacation dates in the cover letter so USCIS is aware of it.

If I receive the biometrics notification and it's scheduled during my vacation, I will just attempt an early walk-in or reschedule.

When it comes to correspondece received during my vacation (as I said: just one week), I believe I should be fine - right?

Does that sound like plan?

My wife also has the same expiration date of you therefore we have taken the plunge and sent out her application last Friday. We may very well get her biometrics appointment before than which can easily be rescheduled. In our case we will both be gone during the same time length (1.5 months to be exact) but the good thing is that we have my parents whom will be checking the mail from time to time to inform us about the letter. If you have someone whom can check your letter for you while your away it shouldn`t be a issue.

Hey everyone

Just a quick question. 2 days ago I sent the package to USCIS but have had to get it intercepted back to my address since based on the time line the biometrics appointment would`ve been taken place next month and they only allow a general reschedule and not customized where we`re allowed to pick our dates. Since her GC expires on the 26th of October and she will be back on the 15th. Would there be a problem if we were to have my parents send it on the 28th of September right before they leave on their trip? Is USCIS strict with filing the ROC package right on the 90 day window?

Looking at the tables/timelines in different groups, it's approximately 30-40 days after sending the package, you will have your bio appointment. Then comes the loooong wait.

My green card expires mid October and I will be abroad second half of October. I've sent my package mid July and hopefully will be done with the bio sometime in August.

I would recommend the OP to do the same and send the package this month., and be done with the bio appointment before the trip.

I'd just include a cover letter stating the dates you will be away and unable to access or attend any appointments. Take a copy of the whole package and keep the mailing receipt safe. You should be fine.
