Hello, I'm thinking of applying again for a Tourist Visa soon, I was denied back in 2012 because I couldn't justify my 4 month stay in the US apparently (back in late 2006). At first I though I had overstayed, but it seems I didn't from what I'm seeing here on my passport. I don't have my i94 from that time, but please check the pictures that show the admittance into the USA and my return to El Salvador:

1. Admitted LAX Sep 29 2006. -- Until March 28 2007

2. Stamp from my Airport upon return 28 January 2007.

I had recently graduated school at the time so I was just visiting places, going to parties, etc. Only thing I have to prove I was just there for fun/leisure/pleasure are some embarassing pictures from Halloween 2006, nothing vulgar, just plain embarassing costume, life of the party if you will, lol. But I doubt they will accept them as evidence.

Other than that I spent time metal detecting and playing some paintball, nothing too crazy.

During the interview in 2012 I explained this to her, I had been working with a Facebook game company here in El Salvador (Zynga) for 2 years now and I had my work letter there for proof, I also had papers showing all the properties my family owns (we have a few houses and several large coffee plantations), we're basically well off, I even took my luxury sports car papers in hopes of providing as much evidence as possible that I am well off here in my country and that I only want to visit ... we just spoke for a while, explained her I just wanted to stay for 2 weeks to visit my mother who is a Citizen whom I hadn't seen in a while and spend some time with her.

Basically she didn't ask to see anything I had taken, not even my job letter. She denied my VISA and I was too angry to reapply that same week as it was the first time in my life they had denied me a US Visa. 2 years later, here I am. I have a pending I130 (IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN) right now which has been there on initial review since February 2, 2012; Would this affect my VISA request?

Any advise would be appreciated, thank you for your time.

Your pending I-130 makes it more difficult for you to obtain a tourist visa.

Why not apply and find out?

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”
