Well its legal in Mexico because we did have it issued but the result may not be in the states. I’m not sure if I should go through with all the hassle of bringing her here especially since I suspect she only wants me for the green card. I’ve heard of a lot of cases like this. We only lived with each other a few days and she already had a lot of critics about my clothing, hair, etc. so I’m not sure if she legitimately loves me or loves my papers…who knows guess I’ll find out.

Annul the fake marriage, work on your relationship with this girl for a while, then think about real marriage in the future when/if you KNOW she is not using you.

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

Sounds like you have problems other than just your fake documents... BTW... Critical of clothing, hair etc Is kinda what wives do... If you don't want criticism, don't get married, we are programmed to try to "improve" everyone...

If you think she is using you why are you even asking these questions? Use common sense, seriously. We don;t need another scammer in the US.

If you apply for a cr1 she can be banned for misrepresentation because you used false documents in order to get married. If you file a k1, you are married(even though you used forged documents). You have a big mess, either way.

I’m going to see if this marriage certificate can be amended if not were going to have to get an annulment and remarry but this time with a legitimate judge, if one exits in Mexico. I appreciate all the input and what not although I found more criticism than solutions but thanks anyway.

Criticism? I think this is what people call common since. Going to Mexico for a weekend and getting married to a girl you just met with a fake birth certificate is not a recipe for success. I think the post is another troll but who knows.

No, I did not marry the girl I had just met. I’ve KNOWN HER for several years, plus I DID TAKE MY AUTHENTIC US DOCUMENTS but the JUDGE REFUSED saying that I had to be LEGALLY ABLED, i.e., meet the following requirements:

“MARRIAGE OF FOREIGNERS IN MEXICO

Directorate General of Civil Registration

The following are REQUIREMENTS for Celebrating Marriage:

- They must meet the requirements set by applicable State Legislation.

- Copy of immigration documents, i.e., the FM proving their legal stay in the country.

- Current release issued by the National Institute of Migration of the Ministry of the Interior, that the immigration status of foreign applicants allows them to perform the legal act.”

HE OFFERED A BYPASS to all this saying I could get registered in Mexico. I thought it wasn’t a big deal until recently when I evaluated my case with several lawyers. Like I said MEXICO IS A SOVEREIGN country and not part of the US so hence they have the RIGHT TO THEIR OWN LAWS, etc. I INITIALLY WANTED TO MOVE IN WITH HER and THEN GET HER A VISA but her parents refused saying I had to sign or no go. And I wasn’t in Mexico for one week my relatives are from there so I thought we got automatic citizen like in the US. Again I blame my NAIVETY.

If this woman is the one that procured a fake BC for you and suggested that you use it to get a quicky wedding, then I would be very suspicious of her motives overall.

Your marriage is not legal in Mexico. It is not legal because it is based on fraud. You cannot get married with fake docs and then say it is a legitimate marriage. Does that make sense? It doesn't matter if you were able to get a marriage cert, it's based on lies.

Don't file for someone who you barely know and who you think is using you. People do get used everyday. When you file for someone, you will be responsible financially for them for 10 years or more, if they don't work. It's a real headache to pay for someone who used you.

If you have only spent a few days with her, then you are unlikely to be approved anyway, because your relationship is underdeveloped. The embassy will go by a "reasonable person standard" to determine if you are trying to defraud the government and circumvent immigration rules. A fake marriage, a few days in person together, fighting with parents, are not things that a "reasonable person" would do.

I tend to agree with this. He....had to get married to please her parents? So they're in on it too because... They insisted on this ... They didn't trust him saying he would get her a visa later (this is what OP has said) so in other words, this whole thing about a visa was front and centre all the way. Not love, not virtue, just the visa. Hard to think this isn't just about the green card in other words.

I almost feel sorry for the OP but I can't see that it is logical for most people to assume getting a fake birth certificate so they can get married quicker and/or cheaper is the way to go. Then again I don't see it's logical to get married because someone's parents don't think you should move in otherwise... And then to get cranky because lawyers want to charge to try fix it but can't guarantee results ...

But to get back to the original post. Whether or not the marriage is fraudulent, from what I have seen people post on VJ before, the intention is clearly there which prevents the use of a K1 visa. Is that correct? But he doesn't have a legal spouse so cannot go that route either.

OP, not to be rude, but are you quite young?

I’m not too young I’m still in my twenties. From my understanding is that it can get corrected but I have to deal with Mexico. It might cost a bit but it can be done. The only problem is if it doesn’t work out here in the states between us I don’t want to be liable for it, i.e., me being on the hook for welfare payments etc. Although I don’t think it will come to that because she does like to work hard but you never know people tend to be shady. The only fault I find in her is that she is TOO SHORT TEMPERED for my taste but I guess you find that out only after living with the person not really during dating.

One thing i don't get is how can one get a BC (by definition a state record of the event of birth) in a country they weren't born in. Didn't you know they're their own country and not part of the US?..

Americans get married abroad all the time. Here you just have to prove you're not married in the US to do it.
