Hello everyone,

My name is Francesco and yes I am a us citizen. I fell in love with a beautiful girl from Peru, I met her back in 2000, she was in Maine on a work visa and we kept in touch with emails. Back in 2004 we decided to date and in January of 2005 I went to Peru and had the best time in my life. I love Peru I had so much fun with my Fiance and seeing the sights. Later in 2005 She got a visa to work in Vermont for over a year. In 2006 (October) I asked her to marry me and she said yes. It is now 2007 and were ready to do the k-1 Visa. I was just wondering what the chances are of her getting approved, can it be 100% if we don't make any mistakes? and I keep hearing about port of entry, can they deny her at POE even if shes been approved in Lima? I was also considering an attorney I would like any thoughts on that. I figure if I get one I wont mess anything up. anyway were just starting and I know its going to be a long road I just want to make less stress as possible for both of us. any input for a newbie would be most welcome.

Sincerely,

Francesco.

Well, everyone on here will tell you that you don't need an attorney unless you have unusual circumstances. If you have nothing unusual about your case (as in no divorces, convictions, etc) then you should be fine to do it yourself. I don't think even with having done everything you can totally say that it will be 100% that they will get a visa. But if you follow all guidelines, make enough to show you've over 125% over poverty level, turn everything in that they ask for and the non USC doesn't have any communiable diseases then you have a really high chance of getting the visa! There's a bit of red tape on everything it seems.

As far as being denied at POE, i've not heard this before? Maybe someone else can tell you stories..

Thanks for the reply,

Also had another question, My fiancee was working on getting a work visa before us decinding to start the K-1, she was denied because the officer issuing the visas told her she was in the US too much and should stay in Peru for a while, This was about 4 months ago. will this effect our chances of success?

If you decide to pursue a K-1, it's best to have her stay in her own country during the process. It's something you have to plan for.

This should not affect your chances of successfully obtaining a K-1 visa. It's a completely separate issue.

All very good information! Yes a person can be denied at the POE if the officer feels like something is not right. They have the final say. That being said, it is not anything to lose sleep over. Treat that stage of the process like any other, make sure all the paperwork is in order and everything will be fine.

Also had one more very important question, Its about the interviews and this is where im confused. My dad is retired army and met my mom in italy and he told me they both had to go through an interview but my fiancee tells me only she has to go through one. Can someone tell me which is correct? and also if I do have to do one can I do it in Lima Peru with her? if so that would be perfect because I would love to bring her back to the states, would be a lot of fun.

Thanks in advance,

Francesco.

About your last question, I have to tell you that the only interview she will have will be in Lima, and if you want to go you are free to do it.I also want you to know that we didnt use a lawyer and everything went very well. Please feel free to contact me, either you or your fiance.
