As a permanent resident there is current no visa number available for your girlfriend to get residence here in the US. There is also no forgiving overstaying visas for family of an LPR. Your girlfriend can apply for ESTA to come on the visa waiver program if there is nothing that prevents her from using it ( certain criminal offenses ) You can marry, she can stay for however long she is admitted for ( max 90 day ) then she must go home. She can return again , however coming too often with a resident husband will get her sent home. There is a thread here titled 'Yes you can visit" you should read The availability of visa numbers depends on how many are in line I have seen everything from immediately available to about 5 years wait over the years. You will not be eligible to apply for USC for 5 years unless you join the military. If your girlfriend overstays and gets caught you could be in big trouble for aiding someone breaking immigration law and make a mess of your green card.

You will need to show you can support your wife ( and any children you have ) The first thing is marry , then get a good job.

This will not be over quickly. You will not enjoy this.

Unfortunatly my girlfriend was not selected at Dv 2015.

I want her to come to the U.S as a tourist to get married here and to wait here for the visa adjustment.

I expecting your opinions.experiences.

You have been told she can come here and get marry but she must go home to wait for an immigration visa which would take 2-3 years.

It is immigration fraud for her "to wait here for the visa adjustment.".

Hello to everyone!

I am a foreign and I intend to go on a turist visa to my boyfriend...

Please help me with a few questions:

1.Is there any problem if we intend to marry and he is a permanent resident? he has this status since 1.5 - 2 months.

2.I have double citizenship, as a hungarian i can come on a visa waiver program...if we marry it will have to be logically with my hungarian documents I suppose...

3.I DO NOT intend to stay more then my visa allowes, but if i stay only 1 month will be enought time for all paperwork and everything which involves the marriage? (in State of Illinois)

4.Will be a problem if he will marry me in 2-3 weeks or less after I arrive?

5.After marriage can he file the I-130 for me or I should be there personally too?

6.After leaving the country can I come to visit again? If I can come, how long after my first visit?

I need all the useful info that you have...

There is no special visa requirement in the US just to get married, so it is okay for a foreigner and a permanent resident to marry. Look up the local laws about marriage where you intend to get married, for specifics. It is pretty easy to get married in the US. Generally, you get a license (permission), which takes a few minutes, then there is a cooling off period, where you have to wait a couple of days or so before you can actually get married. Then you get married, and get the marriage certificate. That's all.

Because your fiance is a resident, as you understand, you can't stay in the US after marriage. He can petition for you and you will have to wait a couple years, depending, for a visa number to be available as the spouse of a resident. You can continue to visit him in accordance with your VWP privileges.

You were told multiple times that this is not going to work and as Harpa mentioned is illegal.

Then theoretically if I stay only 1 month in the US it's enough time to get married... and after that he files for I-130.

Is there any interview or something else which requires my physical presence for a longer stay?

If she comes with the hungarian passport she doesnt need any visa, just 2 fill the ESTA form, but with romanian passport she needs to aplly for a visa.

So my question is how do we proceed? I need 2 get here here with romanian other hungarian documents? Other it`s fine if she comes with hungarian passport and when we get married she gonna show the romanian documents?

Please note there is a huge gap

between

'getting her here'

and

'you chasing a spousal immigrant visa'

for her.

Yep, 1 month will work.

Your interview will be in your home country, or the country where you live now.

But that will happen after your I-130 petition has been approved and also when there is a visa number available for you. That will allow you, when the time is right, to apply for an immigrant visa at the US consulate local to you.

To others: I think this is the OPs gf and they seem to have figured stuff out now.

Thank you for the info...yes i am his gf.

I just wanted to duble check everything, so we do everything in the right way to have better chances to be together...because that is the purpose.
