My fiancee has a green card

I have B1/B2 visa, "i used it many times to visit USA" ,

we are planning to marry soon, then i will apply for LPR, i know it takes like 3 years

I have two questions:

1- after our marriage & applying for LPR, is it possible for me keep visiting USA with my B1/B2 as long as it is valid and i am not violating the rule of max stay 6 months ?

2- Which is better, to marry inside USA or in our home country ? does it make any difference ? what is the cost "money & time" to get marriage paper inside USA ?

1/You can visit while your application is being processed - not sure about the 3-year wait though.

2/Makes no difference. The US recognizes marriage certificates - legal marriage - from all countries.

Travel many times to the US on B1/2 while the processing was going on and had no problems entering.

Although I had documents from my employer I was not asked to show any ties to my home country. Every case is different so just be prepared to prove that you will return to your home country.

I got married in the US as well but it does not matter where you get married. There is usually a small fee for the marriage license and you have to pay for a certified copy when the time comes for that. Do some research on the internet to see what is required for the area you will be visiting.

October 26, 2012: Picked up visa from DHL (delay caused by Sandy)
December 15, 2012: POE Atlanta....................became USC July 2016!!!!

@ Gegel , i heared that Airport passport control may refuse my entry if i applied for LPR ? Is this true ?

It is not entirely true nor is it entirely incorrect either. You will need to be honest with the CBP officer upon arrival and make sure you have documentation showing ties with your home country. Their decision is final.

As the spouse of a LPR you can't AOS stateside so it would not be in your interest to overstay anyway, so, that might count in your favor a little bit.

No for multiple reasons.

1. it is illegal to enter the US on a tourist visa with the intent to immigrate.

2. If she is a LPR then your priority date will not be current, while waiting you will fall out of status and be ineligible for a GC.

2/06/13: APPROVED!

Okay let me rephrase the question ...

As the moment she is my fiance .. we plan to marry .... that's why i said she is my wife .. so please advise with the best way .

1- should we marry inside US or in our home country ?

2- I will not stay inside US all the period after we apply .... i meant just submit the application and go out and come back again when everything is finalized and petitions is approved .

regardless - the answers a year ago not change.

between then and now, PDs became current for alien spouses of LPRs, and stopped being current...

It's a shame he not notice this, between then and now, and act accordingly.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
