Do I count weekends on 30 days from marriage to apply for AOS?

Hello everybody,

I'm a little bit panicked. I got married on Dec 10, 2006, and now I'm unsure as to how to count the 30 days that we have to file for AOS...I'm not quite sure if I should include weekends and/or holidays, so any help would be appreciated.

What 30 days? You got married within the 90 days? Then there's no more deadlines to file for AOS, you can file whenever you want although sooner is wiser, your deadline is now called "as soon as possible" 'cus you know that without the green card you're quite limited.

Not sure where the 30 days is coming from...but it's best to file AOS before the 90 days is up. With that said, there have been others who have filed way past the 90 days with no problems. But, as Laura said, it's best to file ASAP. :)

Sorry, I forgot that part of the story. The law firm that helped us with our K-1 visa also sent us a packet of things to file for the AOS, and in their instructions they said that " Your fiancee’s AOS paperwork should be filed within 30 days after your wedding date. "

Was that just something that they said so that we would do it ASAP? I don't want to scramble unnecessarily and then fail to send an important requirement.

What do you mean, scramble unnecessarily and then fail to send an important requirement? How long do you intend to wait? If you want your wife to work once you're married you'll need to file AOS along with EAD as soon as possible. Of course, this might be a good time to sit down with your lawyer and discuss this.

Maybe the lawyer was just giving you at timeline for his own convenience, or for his services. There's no 30 day deadline but like we said before, you'll want to do it as soon as possible.
