Help needed I-485 filed before OPT expired, what status now?

Hi Everyone,

I submitted my paperwork for I-130, I-485, I-131 and I-765 on 03/17/14 (Next day air) and received the NOA1 on 3/23/14. I am currently working on OPT and my EAD is expiring 04/14/15, my F-1 visa in my passport has already expired in November 2013.

I have 3 questions:

1. What status am I now until I receive the EAD form or GC? (Illegal status because my F-1 and OPT expired?)

2. How long does it take to get the EAD card, what have been your experiences?

3. My wife and I will have a wedding reception in Germany on July 5th. I applied for AP, do you think it will arrive in time? Also, will there be any issues when re entering the U.S.?

1) "Adjustment of status applicant / AoS pending".

2) Within 90 days of application.

3) You'll probably receive it in time, though you're cutting it close.

Thank you for the prompt response. Is the AP a save "ticket" to be able to reenter the U.S. or is it up to the office at the airport? Is there any other documentation needed with the AP?

AP will come in a combo card with your EAD. It is a document that allows reentry into the USA while your AOS is pending.

Bring your NOA1 when you travel not just the EAD/AP combo card.
