I-751 April 2014 Filers

Hi all,

I hope someone would have answer to my question...

I am also a Apr filer to Vermont Center. NOA1 date is Apr 29, 2014. Bio is current. I just got approval letter today. Decision date is Dec 2, 2014. The letter says that I shall receive my green card within 60 days.

My question is - how long does it take usually to get the green card?

If I need to travel aboard for over 3 months before getting my card, is it okay for me to enter USA after 3 months?

Or, shall I ask my husband to mail me the new card when I am still outside of USA?

Or, shall I apply for a travel document to be safe?

My hubby got card in hand on Friday, December 5th!!

It took 2 weeks from our approval date of 11/12/2014 for the card/document production on 11/26/2014. The card was mailed on 12/2/2014 and we received it on 12/5/2014. Hope that timeline helps you out, bonitasummer

just spoke to level one cust service for the umpteenth time expressing frustration that my case was taking too long and others who'd filed many months after me have been cleared. he says that vermont service center is currently processing cases received on may 5th so it's definitely outside the prossessing time. waiting on call back from level 2 in about 40 mins. i already have a request out for status update to the administrator assigned to my case as well.

update -- just heard back from VSC officer...finally level 3 because my case was so delayed. My case has been moved to the local office and they will determine whether or not an interview is needed. wish me luck. anyone been through this?

Update: I filed my husband's paper work for the I-751 Removal of Conditions...on 04/26/2014 and received the I-797 (NOA) on 04/29/2014. His green card expired 07/18/2014 but was shown to have been automatically extended for 1-year as shown on the I-797 (NOA) on 04/29/2014.

I called the USCIS yesterday, 12/10/2014 to inform the USCIS that the 7-month delayed process of ROC - Removal of Conditions was impacting my husband's work due to he has Class A CDL License and the new trucking company that wants to hire him will not accept the I-797 (NOA) of the extended 1-year in lieu of his Green card. Companies are supposed to honor this letter but his Class A CDL license has to be current for his job for more than 1-year. His regular Class C and Class A CDL license both expire on same date, 07/17/2015.

The representative that I spoke with was very kind and helpful and raised a service request yesterday.

Today I received the following statement in an email to me:

Recently, you or your representative contacted USCIS concerning your Petition to Remove Conditions on Residence (Form I-751) to notify us that you believe your case is outside normal processing time. Below is a summary of what we found and how the issue has been or may be resolved.

A review of USCIS records indicates your Form I-751 was approved on December 9, 2014. As of the date of this letter, your Permanent Resident Card (PRC) is in the initial stages of production at the Vermont Service Center. We apologize for the delay in production of your card and for any inconvenience it has caused you. If you do not receive your card within 60 days, please contact customer service at the number below.

We hope this information is helpful to you."

So within the next 60 days, we should be receiving his green card. Thank you for all your support and help.

Hi everyone! Just got off the phone with a level 2 rep. He said that my case had been assigned to an officer at the VT service center on December 2nd for a decision, and I should expect to hear back within 30-45 days. He said that the usual wait time after a case has been assigned is 30 days, but with the holidays coming up, I could expect it to take around 45.

Not sure what my case has been doing for the past 8 months, but hey, at least this is progress. argh. ::headdesk::

Rumor has had it for years that Vermont will RFE ROC applications for no reason other than to reset the processing calendar. This allows them to keep their average processing time looking better than it actually is. If they state its taking six months, and they send you and RFE at six months, you don't go into the count as someone who took 8 months when they calculate average processing time, you're average in at the day they created the RFE.

If the reason for the RFE is for their own lack of ability to comply with a set timeline, that is pathetic.

With that being said, after an exhaustive search of everything we have, we have compiled an arsenal of documents. Thoughts? Will be sending after we return from Spain (fingers crossed that J can get back in the country with that letter)

Here goes...opinions as always appreciated and welcome:

· Copy IRS Tax Transcript for Year 2013, Married filing jointly

· Copy IRS Tax Transcripts for Year 2012 – Married filing separately based on tax professional advise (J came half way through 2012 and would have been taxed on worldwide income if filing jointly)

· Copy IRS Tax Transcript for Year 2011 for L – Married filing separately – J was in Spain until July 2012.

· Copy of joint Fifth Third Bank statements from October 2012-November 2014 – Originally submitted two months.

· Copy of J’s Citi Bank Account statements opened in August 2014 showing joint address

· Copy of L’s Citi Bank Account statements from August 2014 showing joint address

· Copy of L’s Life Insurance from Minnisota Life with J as the primary beneficiary (100%)

· Copy of L’s Fidelity Retirement Fund with Jose as the primary beneficiary (100%)

· Copy of Aetna Health Insurance ID card with both L and J

· Copy of Aetna account usage with both L and J

· Copy of First American Property & Casualty joint property insurance

· Original joint Washington Gas bill

· Copy of welcome letter to our new apartment

· Copy of lease agreement from our new apartment – because Jose does not have established credit, our joint application would have been denied due to the requirements of the apartment complex. L’s credit was used for the apartment; both L and J are listed on the lease.

· Copies of both of our Master’s Degree Diplomas showing graduation date.

· Copy of joint Costco membership card

· Copies of holiday cards addressed to both L and J

· Copy of Thank You note from a friend’s wedding

· Copy of ProFlowers order from J while studying in Providence to L while studying in Cleveland

· Copy of airfare paid for by J for L to come to Spain for the 2011 Christmas holiday during I-130 application period (other airfare can be found in the photo timeline)

· Copy of airfare for L to come to Spain in the summer of 2012. Purchased before approval of conditional residency. J purchased his return ticket from Spain for the same day as L’s return July 19^th upon approval.

· Copy of J’s ticket from Spain to the US, July 19^th, 2012 – with certified translation

· Copy of J’s ticket to Cleveland over Thanksgiving 2012 break for both universities with written sentiments in email

· Copy of J’s ticket to Cleveland for Valentine’s Day 2013 with written sentiments in email

· Ticket Stubs to Madrid, Spain for L’s parents, L and J for Christmas 2014. We flew separately due to work schedules and the fact that my father is ill and I wanted to spend some extra time with my family. - forthcoming

· Four (4) original signed and sworn affidavits of support letters

· Cumulative photo and airfare receipt timeline for duration of our marriage. From April 3^0th, 2011 to December 3^1st, 2014 holiday celebration with both of our families in Spain.

· Screen caps of Skype conversations

o J&L– maintaining communication during separation

o J&L & J’s family – maintaining communication

What do you think, will this be enough to shut them up?
