Well thats at least a positive, you want them to return it all to you, and not cash the check. You filed at Vermont, and given how slow they are to get out NOA1's, returning a petition is probably worse.

Should i be calling USCIS to inquire or let them just do their thing and wait for sometime??

06/12/2018: Received RFE requesting for a Birth Certificate for both parents

07/28/2018: Responded to RFE, sent their non availability of birth certificate copy

08/02/2018: Online status changed to " Request for Evidence was Received"

08/29/2018: Made an info pass appointment requesting for expediting Travel document as parents had to travel India. Expedite request was rejected

:( Not good news. Yes you should be calling to find out what to do. Applying early leads to a denial, but you'll still need to apply within the valid time span. I'm not sure how you go about that with an open case now. Maybe make an infopass and speak with your local. Somehow you need to withdraw and refile. But your money is gone if they cash the check.

I would say don't do anything and wait. If you don't hear anything from them this week then book an infopass next week. Who knows they might overlook your early filling OR they realized since they didn't send you any response on time & now you fall in the 90 days timeframe, they might accept your case.I might be wrong but I would say wait this week. Call USCIS today and ask them what's the update on your case & if they send your NOA yet. :)

You are right they wouldn't be that nice. I'm assuming since they chased his check they might accept or made a decision. He may find out within this week.

You are right they wouldn't be that nice. I'm assuming since they chased his check they might accept or made a decision. He may find out within this week.

This would be a bad thing if his petition is accepted outside the 90 day window. He may have to prove he had good cause to file outside the window, and being mistaken is generally not considered good cause to USCIS. Or possibly they have cashed his check and denial is already coming giving him time to reapply in the window? I'd say make that infopass now. By the time he gets in, whatever is happening with his petition should be in the system for them to look up.

(2) Period for filing petition.-

(A) 90-day period before second anniversary.-Except as provided in subparagraph (B), the petition under subsection ©(1)(A) must be filed during the 90-day period before the second anniversary of the alien's lawful admission for permanent residence.

(B) Date petitions for good cause.-Such a petition may be considered if filed after such date, but only if the alien establishes to the satisfaction of the Attorney General good cause and extenuating circumstances for failure to file the petition during the period described in subparagraph (A).

© Filing of petitions during removal.-In the case of an alien who is the subject of removal hearings as a result of failure to file a petition on a timely basis in accordance with subparagraph (A), the Attorney General may stay such removal proceedings against an alien pending the filing of the petition under subparagraph (B).

I would say don't do anything and wait. If you don't hear anything from them this week then book an infopass next week. Who knows they might overlook your early filling OR they realized since they didn't send you any response on time & now you fall in the 90 days timeframe, they might accept your case.I might be wrong but I would say wait this week. Call USCIS today and ask them what's the update on your case & if they send your NOA yet. :)

You think they might be nice enough to have hold his petition, and issue a NOA1 once the 90 days started? Would be nice of them to do that, but I wouldn't be holding my breath that USCIS would actually do something like that.

05/16/2018: Received Date/ Priority Date - NOA Received

05/25/2018: Received NOA Bio-metrics for I485 Appt: 06/10/2018

06/10/2018: Bio-metrics are completed

06/12/2018: Received RFE requesting for a Birth Certificate for both parents

07/28/2018: Responded to RFE, sent their non availability of birth certificate copy

08/02/2018: Online status changed to " Request for Evidence was Received"

08/29/2018: Made an info pass appointment requesting for expediting Travel document as parents had to travel India. Expedite request was rejected 

09/14/2018: I131 Parole document was Approved
