Hello everybody, my I 751 is still pending and my stamped passport will expires next year July, can I still travel and am scared not be denied because the interviewer was very rude and not nice to use. Please advice, hope I can still enter the country back. Thanks

Hi Weegee....not sure if you're in the right thread but...

Just need to clarify...is it your passport that will expire or will the extension stamp on your passport expire? I'm answering assuming its the extension stamp that will expire...

yes you can still travel...extension gives you all same priviledges as PR doc. Things to consider:

1) Some countries (e.g.) Costa Rica do not allow entry with an extension on your passport and you must have the actual PR card. They also do not allow entry when you're PR (or passport) is about to expire in less than 6 months...you will be denied entry to those particular countries..check the consulate page to see requirements. In such cases, you would need to get a visa on your Ghanian passport. If you're just traveling to Ghana or country where your passport is typically accepted, you can ignore above. Dont assume that your PR extension will be accepted all over....not all countries have treaties w the US (e.g. Canada has a treaty)

2) Ensure that you're case is not in process of consideration for denial. If so, and they come back with a denial while you're away, it could introduce some challenges. One school of thought says you can still re-enter as you will have the opportunity to go to the immigration judge....a more conservative school of thought says that you could be stuck outside and they may consider your case abandoned. Take your pick

3) You can schedule and infopass to get a more concrete answer...or discuss with your attorney to see options.

I called USCIS and according to level 2, my case was approved on Dec 21st. I should expect a letter telling me when to expect my card. I'm cautiously optimistic that this is it....still nervous due to extended delay. Will update hopefully soon w good news.
