The same thing happened to my husband. His tourist visa was cancelled at the border (fiancé back then as well) for the same reasons, same code and everything. He never overstayed on his tourist visa. He already had his interview in Ciudad Juarez and they told him he only needed to file the 212 waiver. not both. At his interview they focused on all the times he entered and departed the U.S. I would suggest you gather or try to remember all the dates as this will be very important at his interview. My husband said everytime he was asked a question, the officer would check on his computer. Hope this helps. I am getting ready to send off his waiver.

Only I 212 is needed for immigrant intent...now what led them to

believe that? If for example something they read or found led them

to this thinking, a misrep could loom...the ball is in their court,

have a waiver atty go over every piece of paper then you will

know what bans will be at interview....a lone I 212 can take a few

weeks to a year depending on jurisdiction...I say hold unto funds

in case I 601 is needed...both waivers filed together now takes 6-12

months, there are still 2/13 filers waiting on decisions.

YOU DO NOT have to wait 5 yrs to petition your husband, he has no

criminal charges, talk to an atty that give free consult they R the experts...best wishes

Hello everyone

I too fall on same category and in january 15 2015 met the five 5 bar. I am currently waiting on NVC to review and cc for interview in CDJ

if things go well. Will I need I 212? even though i have waited out 5 year ban?
